         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Health  
         Services was held on Tuesday, February 16, 1999, in the  
         Capitol Extension, Room E1.016, at Austin, Texas.

         The Chair called the meeting to order at 1:30 p.m..  There  
         being a quorum present, the following business was transacted.   
          
         The following member arrived after the roll was called: 
         Senator Nixon. 
          
         The Chair laid out the February 9, 1999, minutes and  
         recognized Senator Madla who moved for their approval.  There  
         being no objection, the motion prevailed by unanimous consent. 
          
         At 1:32 p.m., Senator Moncrief assumed the chair.   
          
         The Chair laid out SB 122 and recognized the bill's author,  
         Senator Nelson, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  
          
         Senator Nelson sent up Committee Amendment 1 and moved for its  
         adoption; without objection, the amendment was adopted. 
          
         Senator Nelson sent up Committee Amendment 2 and moved for its  
         adoption; without objection, the amendment was adopted. 
          
         Senator Nelson sent up Committee Amendment 3 and moved for its  
         adoption; without objection, the amendment was adopted. 
         Senator Nelson requested unanimous consent to incorporate  
  
         committee amendments into a committee substitute; there being  
         no objection, the motion was adopted.  
          
         Senator Nelson moved that SB122 do not pass, but that CSSB 122  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 5  
         ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         The Chair laid out SB 131 and recognized the bill's author,  
         Senator Nelson, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Nelson moved that SB 131 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         At 2:22 p.m. Senator Nelson resumed the chair.   
          
         The Chair laid out SB 261 and recognized the bill's author,  
         Senator Moncrief, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Moncrief  to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Moncrief moved adoption of the committee substitute; without  
         objection, it was so ordered.  
          
         Senator Moncrief moved that SB 261 do not pass, but that CSSB  
         261 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         The Chair laid out SB 414 and recognized the author, Senator  
         Madla, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Madla moved that SB 414 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair laid out SB 99 and recognized the bill's author,  
         Senator Carona, to explain the bill.   
  
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Madla sent up a committee substitute; the Chair  
         recognized Senator Madla to explain the difference between the  
         committee substitute and the bill as filed.   
          
         Senator Moncrief sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.    
          
         Senator Moncrief requested unanimous consent to incorporate  
         the amendment into the committee substitute;  without  
         objection, it was so ordered.   
          
         Senator Moncrief then moved that the new committee substitute  
         be adopted; without objection, it was so ordered.   
          
         Senator Moncrief moved that SB 99 do not pass, but that CSSB  
         99 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a vote of  
         5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Moncrief moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out SB 389 and recognized the bill's author,  
         Senator Madla, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Madla moved that SB 389 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 61 and recognized the bill's author,  
         Senator Madla, to explain the bill.   
         Senators Moncrief and Lindsay now absent.

         the attached list.   
          
         Senator Madla moved that SB 61 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 3 ayes, 0 nays, 0 present  
         not voting, and 2 absent.   
          
         There being no further business, at 3:06 p.m., Senator Madla  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
