         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Natural  
         Resources was held on Thursday, April 8, 1999 in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 2:35 pm.  There being  
         a quorum present, the following business was transacted.   
          
         At 2:35 pm, Senator Armbrister assumed the Chair.   
          
         The Chair laid out SB 1733 and Senator Brown sent up a  
         Committee Substitute and explained the differences to the  
         Substitute. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list. 
          
         Public testimony on the bill was closed and Senator Brown  
         moved adoption of the Committee Substitute; without objection,  
         the Substitute was adopted.  The bill was left pending,  
         awaiting a quorum. 
          
         At 2:40 pm, Senator Brown assumed the Chair. 
          
         The Chair laid out SB 199 and Senator Moncrief, the author,  
         explained the bill. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list. 
          
         Public testimony on the bill was closed and the bill was left  
  
         pending, awaiting a quorum. 
          
         A witness on SB 199, Cindy Scmitt, was shown as regsitering  
         for the bill. 
          
         The Chair laid out SB 396 and Senator Moncrief, the author,  
         explained the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list. 
          
         The bill was left pending awaiting the arrival of a quorum. 
          
         The Chair laid out SB 459 and Senator Moncrief, the author,  
         explained the bill. 
          
         No public testimony was given on the bill and SB 459 was left  
         pending, awaiting the arrival of a quorum. 
          
         The Chair laid out SB 1403 and Senator Armbrister explained  
         the bill for the author, Senator Fraser.  Senator Armbrister  
         sent up Committee Amendment One and moved its adoption;  
         without objection, the Amendment was adopted.  No public  
         testimony was given on the bill.  The bill was left pending  
         before the Committee, awaiting the arrival of the House  
         companion bill. 
          
         At 3:14 pm, Senator Armbrister assumed the Chair. 
          
         The Chair laid out SB 1731 and Senator Brown explained the  
         bill.  Public testimony was closed and the bill was left  
         pending, awaiting the arrival of a quorum.   
          
         At 3:18 pm, Senator Brown assumed the Chair and laid out SB  
         1316.  Senator Armbrister explained the bill.

         awaiting the arrival of a quorum.   
          
         At 3:35 pm, Senator Armbrister assumed the Chair and laid out  
         SB 1010.  Senator Brown sent up a Committee Substitute and  
         explained the differences to the Substitute. 
          
         Witnesses testifying and registering no the bill are shown on  
         the attached list. 
          
         Senator Brown sent up Committee Amendment One and moved its  
         adoption; without objection, the amendment was adopted.   
         Senator Brown moved adoption of the Committee Substitute;  
         without objection, the Substitute was adopted.  Senator Brown  
  
         moved that Amendment One be rolled into a new Committee  
         Susbtitute; without objection, it was so ordered.  The bill  
         was left pending before the Committee.   
          
         At 4:22 pm, Senator Brown assumed the Chair and laid out SB  
         708.  Senator Jackson, the author, explained the bill and  
         Senator Armbrister sent up a Committee Substitute.  Senator  
         Armbrister sent up Committee Amendment One and moved its  
         adoption; without objection, the Amendment was adopted.

         Senator Armbister moved that the Committee Substitute be  
         adopted; without objection, the Substitute was adopted.   
         Senator Armbrister moved that Committee Amendment One be  
         rolled into a new Committee Substitute; without objection, it  
         was so ordered.  The bill was left pending before the  
         Committee. 
          
         The Chair laid out SB 1746 and Senator Jackson, the author,  
         explained the bill.  Senator Armbrister sent up a Committee  
         Substitute.

         Senator Armbrister moved adoption of the Committee Substitute;  
         without objection, the Substitute was adopted.  Senator  
         Armbrister moved that CSSB 1746 pass and be reported favorably  
         to the full Senate.  The motion carried with a vote of 4 ayes,  
         0 nays, 0 present not voting, and 3 absent.  Senator  
         Armbrister  moved that CSSB 1746 be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered. 
          
         Senator Armbrister moved that SB 199 be reported favorably to  
         the full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Armbrister  
         moved that SB 199 be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered. 
          
         Senator Armbrister moved that CSSB 1733 be reported favorably  
         to the full Senate.  The motion carried with a vote of 5 ayes,  
         0 nays, 0 present not voting, and 2 absent.  Senator Lucio  
         moved that CSSB 1733 
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered. 
          
         Senator Armbrister moved that SB 396 be reported favorably to  
         the full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Lucio moved  
         that SB 396 be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered. 
          
         Senator Armbrister moved that SB 459 be reported favorably to  
         the full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Armbrister  
         moved that SB 459 be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered. 
          
         Senator Armbrister moved that SB 1731 be reported favorably to  
         the full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Armbrister  
         moved that SB 1731 be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered. 
          
         Senator Lucio moved that CSSB 1154 be reported favorably to  
         the full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.   
          
         Senator Armbrister moved that CSSB 1797 be reported favorably  
         to the full Senate.  The motion carried with a vote of 5 ayes,  
         0 nays, 0 present not voting, and 2 absent.  Senator  
         Armbrister moved that CSSB 1797 be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered. 
          
         Senator Armbrister moved to reconsider his vote on CSSB 1500;  
         there being no objection it was so ordered.  Senator  
         Armbrister moved that CSSB 1500 be reported favorably to the  
         full Senate.  The motion carried with a vote of 5 ayes, 0  
         nays, 0 present not voting and 2 absent. 
          
         The Chair laid out SCR 56 and Senator Lindsey, the author,  
         explained the bill.  Senator Armbrister sent up a Committee  
         Substitute.

         The bill was left pending before the Committee. 
          
         Senator Armbrister sent up the Subcommittee on Ag report on  
         CSSB 705.  Senator Armbrister sent up a new Committee  
         Substitute.  Senator Armbrister sent up Committee Amendment  
         One and moved its adoption; without objection, the Amendment  
         was adopted.  Senator Ogden, the author, explained the bill.

         Senator Armbrister moved that the Committee Substitute be  
         adopted; without objection, the Substitute was adopted.  
         Senator Armbrister moved that Amendment One be rolled into a  
         new Committee Substitute; without objection, it was so

         The Chair laid out SB 1272 and Senator Wentworth, the author,  
         explained the bill.  Senator Armbrister sent up a Committee  
         Substitute.

         Senator Armbrister moved that the Committee Substitute be  
         adopted; without objection, the Substitute was adopted.  The  
         bill was left pending before the Committee. 
          
         At 6:15 pm, Senator Armbrister assumed the Chair. 
          
         The Chair laid out SB 1302 and Senator  Brown explained the  
         bill.  Senator Brown sent up Committee Amendment One and moved  
         adoption; without objection, the Amendment was adopted.

         The bill was left pending before the committee. 
          
         There being no further business, at 6:57 pm Senator Armbrister  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
