         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing Senate Subcommittee on Infrastructure  
         was held on Tuesday, April 27, 1999 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 8:40 a.m.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         Senator J. E. Brown 
         Senator Drew Nixon 
          
         Senator Bernsen moves that the minutes from the previous  
         meeting be approved, without objection, it was so ordered. 
          
         The Chair laid out SB 1872 and recognized the author, Senator  
         Lindsay, to explain the bill.   
          
         Senator Lucio, Jr. sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Lucio, Jr. moved that SB 1872, as amended, be reported  
         back to the full Committee with the recommendation that it do  
         pass.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         The rules were suspended to take up and consider SB 923. 
          
         The Chair laid out SB 923 and recognized the author, Senator  
         Wentworth, to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Wentworth to explain the difference between  
  
         the committee substitute and the bill as filed.  Senator  
         Lucio, Jr. moved adoption of the committee substitute, without  
         objection, it was so ordered.

         At 8:51 a.m. Senator Bernsen assumed the chair.   
          
         Senator Lucio, Jr. moved that SB 923 do not pass but that CSSB  
         923 be reported back to the full Committee with the  
         recommendation that it do pass.  The motion carried with a  
         vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.   
          
         At 8:55 a.m. Senator Cain resumed the chair.   
          
         The Chair laid out SB 193 and recognized the author, Senator  
         Ogden, to explain the bill.

         and 2 absent.   
          
         Senator Lucio, Jr. moved that SB 791 do not pass but that CSSB  
         791 be reported back to the full Committee with the  
         recommendation that it do pass.  The motion carried with a  
         vote of 3 ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         At 3:45 p.m. Senator Nixon assumed the chair.   
          
         The rules were suspended to take up and consider HB 3092. 
          
         The Chair laid out HB 3092 and recognized the Senate sponsor,

         Senator Cain sent up a committee substitute; the Chair

         that it do pass.  The motion carried with a vote of 3 ayes, 0  
         nays, 0 present not voting, and 2 absent.   
          
         At 3:48 p.m. Senator Cain resumed the chair.

         absence of the author, to explain the bill.   
          
         Senator Nixon sent up Committee Amendment 1 to a previously  
         adopted substitute and moved adoption; without objection, the  
         amendment was adopted.   
          
         Senator Nixon requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Nixon then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.
