         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Thursday, April 29, 1999 in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 4:05 pm.  There being  
         a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:  
         Senator Shapleigh, Senator Bernsen and Senator Haywood. 
          
         The subcommittee report on CSSB 349 was laid out by the Chair.   
         Senator Brown moved that the subcommittee report be adopted.   
         There being no objection, it was so ordered.    
          
         Senator Brown moved that SB 349 do not pass but that CSSB 349  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 2 absent.  Senator  
         Brown moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The subcommittee report on CSSB 791 was laid out by the Chair.   
         Senator Brown moved adoption of the subcommittee report.   
         There being no objection, it was so ordered. 
          
         Senator Brown moved that SB 791 do not pass but that CSSB 791  
         be reported back to the Senate with the recommendation that it  
  
         do pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 2 absent.  Senator  
         Brown moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The subcommittee report on CSSB 923 was laid out by the Chair.   
         Senator Wentworth was recognized for an explanation of the  
         bill.  Senator Brown moved adoption of the subcommittee  
         report.  There being no objection, it was so ordered. 
          
         Senator Brown moved that SB 923 do not pass but that CSSB 923  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         The subcommittee report on CSSB 1511 was laid out by the  
         Chair.  Senator Brown moved adoption of the subcommittee  
         report.  There being no objection, it was so ordered. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Brown moved that SB 1511 do not pass but that CSSB  
         1511 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         The subcommittee report on SB 1872, as amended, was laid out  
         by the Chair.  Senator Brown moved adoption of the  
         subcommittee report.  There being no objection, it was so  
         ordered. 
          
         Senator Brown moved that SB 1872, as amended, be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.   
          
         The Chair laid out SB 1092 and recognized the author, Senator  
         Brown, to explain the bill.   
          
         Senator Brown sent up a committee substitute; the Chair  
         recognized Senator Brown to explain the difference between the  
         committee substitute and the bill as filed.  Senator Lucio,  
         Jr. moved adoption of the committee substitute, without  
         objection, it was so ordered.

         At 4:34 pm Senator Shapleigh assumed the chair.   
          
         Senator Brown moved that SB 1092 do not pass but that CSSB  
         1092 be reported back to the Senate with the recommendation  
  
         that it do pass and be printed.  The motion carried with a  
         vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.   
         Senator Brown moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair laid out HB 1539 and recognized the Senate sponsor,  
         Senator Nelson, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on

         Senator Lucio, Jr. moved that HB 1539 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator Lucio, Jr. moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 1031 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on

         Senator Lucio, Jr. moved that HB 1031 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0

         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 1353 and recognized the author, Senator  
         Barrientos, to explain the bill.   
          
         Senator Bernsen sent up a committee substitute; the Chair  
         recognized Senator Barrientos to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Bernsen moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Shapleigh moved that CSSB 1353 be left pending;  
         without objection, it was so ordered. 
          
         The Chair laid out SB 1220 and recognized Senator Bernsen, in  
         the absence of the author, to explain the bill.   
          
         Senator Bernsen sent up a committee substitute; the Chair  
         recognized Senator Bernsen to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Wentworth moved adoption of the committee substitute, without  
         objection, it was so ordered.

         At 5:24 pm Senator Shapiro resumed the chair.   
          
         The Chair moved that CSSB 1220 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum,  Senator Brown moved that SB 1220 do not pass but  
         that CSSB 1220 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 8 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Bernsen moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 5:25 pm Senator Nixon assumed the chair.   
          
         The Chair laid out SB 1828 and recognized the author, Senator  
         Shapiro, to explain the bill.   
          
         Senator Shapiro sent up a committee substitute; the Chair  
         recognized Senator Shapiro to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Shapiro moved adoption of the committee substitute, without  
         objection, it was so ordered.

         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum,  Senator Shapiro moved that SB 1828 do not pass but  
         that CSSB 1828 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 8 ayes, 0 nays, 0 present not voting,  
         and 1 absent.   
         The Chair laid out HB 510 and recognized Senator Bernsen, in  
         the absence of the Senate sponsor, to explain the bill.

         The Chair moved that HB 510 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Wentworth moved that HB 510 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator Bernsen moved that  
         the bill be recommended for placement on the Local &

         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 8  
         ayes, 0 nays, 0 present not voting, and 1 absent.  Senator  
         Bernsen moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The Chair laid out SB 1520 and recognized Senator Nixon, in  
         the absence of the author, to explain the bill.

         the absence of the author, to explain the bill.   
          
         Senator Shapiro sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum,  Senator Nixon moved that SB 1364, as  
         amended, be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 8 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Nixon moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
         At 7:18 pm Senator Shapiro resumed the chair.   
          
         The Chair laid out SB 838 and recognized the author, Senator  
         Wentworth, to explain the bill.   
         Senator Wentworth sent up a committee substitute; the Chair  
         recognized Senator Wentworth to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Wentworth moved adoption of the committee substitute, without  
         objection, it was so ordered. 
          
         Senator Wentworth moved that SB 838 do not pass but that CSSB  
         838 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         The Chair laid out SJR 27 and recognized the author, Senator  
         Wentworth, to explain the bill.   
          
         Senator Wentworth sent up a committee substitute; the Chair

         the committee substitute and the bill as filed.  Senator  
         Wentworth moved adoption of the committee substitute, without  
         objection, it was so ordered.

         Senator Haywood moved that SB 644 do not pass but that CSSB  
         644 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.   
          
         At 7:57 pm Senator Brown assumed the chair.   
          
         At 8:00 pm Senator Shapiro resumed the chair.   
          
         There being no further business, at 8:02 pm Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
