         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Tuesday, April 13, 1999 in the Capitol  
         Extension, Room E1.028, at Austin, Texas.

         The Chair called the meeting to order at 12:50 pm.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:  
         Senator Lucio, Senator Wentworth, Senator Nixon and Senator  
         Bernsen. 
          
         Senator Shapleigh moved that the minutes from the April 8,  
         1999, State Affairs Committee meeting be approved.  There  
         being no objection, the minutes were approved. 
          
         The Chair referred the following bill to the Standing  
         Subcommittee on Infrastructure: 
         SB 1098 by Cain 
          
         The Chair laid out SB 418 and recognized the author, Senator  
         Moncrief, to explain the bill.   
          
         Senator Shapleigh sent up a committee substitute; the Chair  
         recognized Senator Moncrief to explain the difference between  
         the committee substitute and the bill as filed.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
  
         The Chair advised that she had three amendments which were  
         acceptable to the author.  The author had agreed not to adopt  
         the amendments at this time so that he could incorporate the  
         amendments into a new committee substitute to be brought  
         before the committee at a later date.  The Chair explained her  
         amendments to the committee. 
          
         At 1:40 pm Senator Shapleigh assumed the chair.   
          
         Senator Wentworth explained a fourth amendment that  also was  
         not adopted at this time. 
          
         The Chair moved that SB 418 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1260 and recognized the author, Senator  
         Moncrief, to explain the bill.   
          
         Senator Wentworth sent up a committee substitute; the Chair  
         recognized Senator Moncrief to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Wentworth moved adoption of the committee substitute, without  
         objection, it was so ordered. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that CSSB 1260 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum,  Senator Shapleigh moved that SB 1260 do not pass  
         but that CSSB 1260 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent. Senator Wentworth moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 2:30 pm Senator Wentworth assumed the chair.   
          
         The Chair laid out SB 1382 and recognized the author, Senator  
         Shapleigh, to explain the bill.   
          
         The Chair sent up a committee substitute; the Chair recognized  
         Senator Shapleigh to explain the difference between the  
         committee substitute and the bill as filed.  Senator Shapleigh  
         moved adoption of the committee substitute, without objection,  
         it was so ordered.

         the attached list.   
          
         The Chair moved that CSSB 1382 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum,  Senator Wentworth moved that SB 1382 do not pass  
         but that CSSB 1382 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.  Senator Wentworth moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out SB 1664 and recognized the author, Senator  
         Shapleigh, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that SB 1664 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Wentworth moved that SB 1664 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 7 ayes, 0 nays,  
         0 present not voting, and 2 absent.  Senator Wentworth moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         At 2:40 pm Senator Shapiro resumed the chair.   
          
         The Chair laid out SB 1099 and recognized Senator Wentworth,  
         in the absence of the author, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that SB 1099 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Shapleigh moved that SB 1099 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 7 ayes, 0 nays,  
         0 present not voting, and 2 absent.  Senator Shapleigh moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 1314 and recognized the author, Senator  
         Armbrister, to explain the bill.   
         Senator Wentworth sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         Senator Shapleigh moved that SB 1314, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 7 ayes, 0 nays,  
         0 present not voting, and 2 absent.   
          
         The Chair laid out SB 1127 and recognized the author, Senator  
         Armbrister, to explain the bill.   
          
         Senator Shapleigh sent up a committee substitute; the Chair  
         recognized Senator Armbrister to explain the difference  
  
         between the committee substitute and the bill as filed.   
         Senator Shapleigh moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Lucio, Jr. moved that SB 1127 do not pass but that  
         CSSB 1127 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Lucio, Jr. moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out SB 761 and recognized the author, Senator  
         Duncan, to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Duncan to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Shapleigh moved adoption of the committee substitute, without  
         objection, it was so ordered. 
          
         Senator Shapleigh moved that SB 761 do not pass but that CSSB  
         761 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 6 ayes, 0 nays, 0 present not voting, and 3 absent.   
          
         The Chair laid out SB 1130.   
          
         Senator Shapleigh moved to reconsider the vote on which the  
         committee substitute for SB 1130 was adopted.  There being no  
         objection, the vote was reconsidered. 
          
         Senator Shapleigh moved to withdraw his motion to adopt the  
         substitute.  There being no objection, the motion and the  
         substitute were withdrawn. 
          
         Senator Shapleigh sent up a committee substitute for SB 1130;  
         the Chair recognized Senator Armbrister, to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Lucio, Jr. moved adoption of the committee  
         substitute, without objection, it was so ordered. 
          
         Senator Lucio, Jr. moved that SB 1130 do not pass but that  
         CSSB 1130 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 6 ayes, 0 nays, 0 present not voting,  
         and 3 absent.   
          
         At 3:30 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out SB 679 and recognized the author, Senator  
         Shapiro, to explain the bill.   
  
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Shapiro to explain the difference between  
         the committee substitute and the bill as filed.  Senator Nixon  
         moved adoption of the committee substitute, without objection,  
         it was so ordered. 
          
         Senator Nixon moved that SB 679 do not pass but that CSSB 679  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 6  
         ayes, 0 nays, 0 present not voting, and 3 absent.   
          
         At 3:34 pm Senator Shapiro resumed the chair.   
          
         There being no further business, at 3:35 pm Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
