         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Thursday, March 18, 1999 in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 1:45 pm.  There being  
         a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:  
         Senator J. E. Brown, Senator Eddie Lucio, Jr., Senator Jeff  
         Wentworth and Senator Tom Haywood. 
          
         Senator Shapleigh moved that the State Affairs Committee  
         minutes from March 16, 1999, be approved.  There being no  
         objection, the minutes were approved. 
          
         The Chair referred the following bills to the Standing  
         Subcommittee on Infrastructure: 
         SB 561 by Duncan 
         SB 791 by Nixon 
         SB 865 by Lucio 
         SB 942 by Armbrister 
         SB 1444 by Barrientos 
         SB 1446 by Barrientos

         The Chair laid out SB 483 and recognized the author, Senator  
         Duncan, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Bernsen moved that SB 483 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         At 2:00 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out SB 770 and recognized the author, Senator  
         Shapiro, to explain the bill.   
          
         Senator Brown moved that SB 770 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  Senator Shapiro moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         At 2:05 pm Senator Shapiro resumed the chair.   
          
         The subcommittee report on SB 401 was laid out by Senator  
         Cain.  Senator Cain moved adoption of the subcommittee report.   
         There being no objection, the subcommittee report was adopted. 
          
         Senator Cain moved that SB 401 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 0 absent. Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The subcommittee report on SB 735 was laid out by Senator  
         Cain.  Senator Cain moved adoption of the subcommittee report.   
         There being no objection, the subcommittee report was adopted. 
          
         Senator Cain moved that SB 735 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  Senator Nixon moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         At 2:10 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out SB 29 and recognized the author, Senator

         Senator Shapleigh sent up a committee substitute; the Chair

         The Chair laid out SB 845 and recognized the author, Senator  
         Carona, to explain the bill.   
          
         Senator Shapleigh sent up a committee substitute; the Chair  
         recognized Senator Carona to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Shapleigh moved adoption of the committee substitute, without  
         objection, it was so ordered.

         Senator Shapleigh moved that SB 845 do not pass but that CSSB  
         845 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         Senator Lucio, Jr. moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out SB 411 and recognized the author, Senator  
         Duncan, to explain the bill.   
          
         Senator Brown sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         Senator Brown moved that SB 411, as amended, be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 1 nay, 0

         The Chair laid out SB 884 and recognized the author, Senator  
         Brown, to explain the bill.

         Senate with the recommendation that it do pass and be printed.

         Senator Shapleigh moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out SB 239 and recognized Senator Lucio, Jr.,  
         in the absence of the author, to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Lucio, Jr. moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Lucio, Jr. moved that SB 239 be left pending; without  
         objection, it was so ordered. 
          
         At 6:55 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out SB 679 and recognized the author, Senator  
         Shapiro, to explain the bill.   
          
         Senator Shapiro sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         The Chair asked that testimony on SB 679, as amended, be  
         interrupted in order to take up and consider SB 564 before the  
         author left. 
          
         At 8:30 pm Senator Shapiro resumed the chair.   
          
         The Chair laid out SB 564 and recognized the author, Senator  
         Duncan, to explain the bill.

         amended. 
          
         Senator Shapleigh moved that SB 679, as amended, be left  
         pending; without objection, it was so ordered. 
          
         There being no further business, at 9:10 pm Senator Shapleigh  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
