Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on State
Affairs was held on Thursday, February 18, 1999 in the Senate
Chamber at Austin, Texas.

The Chair called the meeting to order at 1:10 pm. As the
committee was in recess, the Chair proceeded to lay out bills.
The Chair laid out SB 355 and recognized the author, Senator
Harris, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
The Chair moved that SB 355 be left pending to await a quorum;
without objection it was so ordered.
The Chair laid out SB 191 and recognized the author, Senator
Ogden, to explain the bill.
Senator Brown sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. The
Chair moved that SB 191 be left pending to await a quorum;
without objection it was so ordered.
The Chair laid out SB 223 and recognized the author, Senator
Ogden, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Brown sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. The
Chair moved that SB 223 be left pending to await a quorum;
without objection it was so ordered.
The roll was called and a quorum was present at 1:30 pm. The
following members arrived after the roll was called: Senator
Shapleigh.
The following business was transacted.
Senator Wentworth moved approval of the minutes for the
February 11, 1999, State Affairs Committee meeting. There
being no objection, the minutes were approved.
The Chair referred the following bills to the Standing
Subcommittee on Infrastructure:

The Chair recalled SB 223. Senator Lucio, Jr. moved that SB
223, as amended, be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 1 absent.
The Chair recalled SB 191. Senator Lucio, Jr. moved that SB
191, as amended, be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 1 absent.
The Chair recalled SB 355. Senator Shapiro moved that SB 355
be left pending; without objection, it was so ordered.
The Chair laid out SB 408 and recognized the author, Senator
Duncan, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Lucio, Jr. moved that SB 408 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 0 nays, 0
present not voting, and 1 absent.
Senator Brown moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out SB 60 and recognized the author, Senator
Moncrief, to explain the bill.
Senator Brown sent up a committee substitute; the Chair
recognized Senator Moncrief to explain the difference between
the committee substitute and the bill as filed. Senator Brown
moved adoption of the committee substitute, without objection,
it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Brown sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Brown requested unanimous consent to incorporate
amendments into the committee substitute. Senator Brown then
moved that the new committee substitute be adopted, without
objection, it was so ordered.
Senator Shapiro moved that SB 60 do not pass but that CSSB 60
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 7
ayes, 0 nays, 0 present not voting, and 2 absent.
The Chair laid out SB 356 and recognized the author, Senator
Brown, to explain the bill.

Senator Brown moved that SB 356 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 8 ayes, 0 nays, 0 present
not voting, and 1 absent.
Senator Brown moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out SB 100 and in the absence of the author,
explained the bill.
Senator Brown sent up a committee substitute; the Chair
explained the difference between the committee substitute and
the bill as filed. Senator Brown moved adoption of the
committee substitute, without objection, it was so ordered.
Senator Haywood moved that SB 100 do not pass but that CSSB
100 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Brown moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
There being no further business, at 3:15 pm Senator Shapiro
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
