                     SENATE SUBCOMMITTEE ON HIGHER EDUCATION

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing Senate Subcommittee on Higher  
         Education was held on Monday, March 22, 1999 in the Capitol  
         Extension, Room E1.016, at Austin, Texas.

         The Chair called the meeting to order at 6:45 pm.  There being  
         a quorum present, the following business was transacted.   
          
         Senator Nelson moved that the minutes from the prior committee  
         hearing be approved;  there being no objection, the minutes  
         were approved. 
          
         Senator Ogden assumed the Chair at 6:45 pm. 
          
         The Chair laid out SB 149 and recognized Senator West, in the  
         absence of the author, to explain the bill.  Senator West sent  
         up a committee substitute; the Chair recognized Senator West  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Ogden moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator West moved that SB 149 do not pass  
         but that CSS 149 be reported back to the full Committee with  
         the recommendation that it do pass.  The motion carried with a  
         vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.   
          
         Senator West resumed the Chair at 6:50 pm. 
          
         The Chair laid out SB 979 and recognized the author, Senator  
         Haywood, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Ogden moved that SB 979 be reported favorably to the  
         full Committee with the recommendation that it do pass.  The  
         motion carried with a vote of 4 ayes, 0 nays, 0 present not  
         voting, and 1 absent.   
  
         The Chair laid out SB 1716 and recognized Senator Nelson, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Nelson moved that SB 1716 be reported  
         favorably to the full Committee with the recommendation that  
         it do pass.  The motion carried with a vote of 4 ayes, 0 nays,  
         0 present not voting, and 1 absent.   
          
         The Chair laid out SB 1765 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Nelson moved that SB 1765 be reported favorably to the  
         full Committee with the recommendation that it do pass.  The  
         motion carried with a vote of 4 ayes, 0 nays, 0 present not  
         voting, and 1 absent.   
          
         The Chair laid out SB 1763 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Ogden sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Ogden moved that SB 1763, as amended, be reported back  
         to the full Committee with the recommendation that it do pass.   
         The motion carried with a vote of 4 ayes, 0 nays, 0 present  
         not voting, and 1 absent.   
          
         The Committee recessed at 7:15 pm until after adjournment of  
         the full Senate. 
          
         The Committee reconvened at 7:25 pm. 
          
         The Chair laid out SB 947 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Ogden sent up a  
         committee substitute; the Chair recognized Senator Barrientos  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Ogden moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  Senator West moved that SB 947 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 746 and recognized the author, Senator  
         Shapleigh, to explain the bill. Senator Ogden sent up a  
         committee substitute; the Chair recognized Senator Shapleigh  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Ogden moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  Senator Nelson moved that SB 746 do not  
         pass but that CSS 746 be reported back to the full Committee  
         with the recommendation that it do pass.  The motion carried  
         with a vote of 4 ayes, 0 nays, 0 present not voting, and 1  
         absent.   
          
         The Chair laid out SB 590 and recognized the author, Senator  
         Truan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Zaffirini sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator West moved that SB 590 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 940 and recognized the author, Senator  
         Armbrister, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Nelson moved that SB 940 be reported favorably to the  
         full Committee with the recommendation that it do pass.  The  
         motion carried with a vote of 4 ayes, 0 nays, 0 present not  
         voting, and 1 absent.   
          
         The Chair laid out SB 562 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Zaffirini moved that SB 562 be reported favorably to  
         the full Committee with the recommendation that it do pass.   
         The motion carried with a vote of 4 ayes, 0 nays, 0 present  
         not voting, and 1 absent.   
          
         The Chair laid out HB 229 and recognized the Senate sponsor,  
         Senator Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Ogden moved that HB 229 be reported favorably to the  
         full Committee with the recommendation that it do pass.  The  
         motion carried with a vote of 4 ayes, 0 nays, 0 present not  
         voting, and 1 absent.   
          
         There was no action taken on SB 758 by Duncan. 
          
         The Chair laid out SB 900 and recognized the author, Senator  
         Sibley, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Nelson moved that SB 900 be reported favorably to the  
         full Committee with the recommendation that it do pass.  The  
         motion carried with a vote of 4 ayes, 0 nays, 0 present not  
         voting, and 1 absent.   
          
         There being no further business, at 8:35 pm Senator West moved  
         that the Committee stand recessed subject to the call of the  
         Chair.  Without objection, it was so ordered.
