         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, May 5, 1999 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 1:45 pm. The  
         following business was transacted.   
          
         At 1:45 pm Senator Zaffirini assumed the chair.   
          
         The Chair laid out SB 1897 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1897 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins moved that SB 1897 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Bivins moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         At 1:50 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 1325 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Zaffirini sent up a committee substitute; the Chair  
         recognized Senator Gallegos, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Zaffirini moved adoption of the committee substitute,  
         without objection, it was so ordered. 
         At 2:00 pm Senator Zaffirini assumed the chair.   
  
         Senator Bivins sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
          
         At 2:02 pm Senator Bivins resumed the chair.   
          
         The Chair moved that SB 1325 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Zaffirini requested unanimous consent to  
         incorporate the amendment into the committee substitute;   
         without objection, it was so ordered.  Senator Zaffirini then  
         moved that the new committee substitute be adopted; without  
         objection, it was so ordered.  Senator Zaffirini moved that SB  
         1325 do not pass but that CSSB 1325 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent. Senator Zaffirini moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 1346 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         The Chair moved that HB 1346 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Ogden sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Zaffirini requested unanimous consent to incorporate  
         the amendment into the bill to create a committee substitute;   
         without objection, it was so ordered.  Senator Zaffirini then  
         moved that the new committee substitute be adopted; without  
         objection, it was so ordered.  Senator Zaffirini moved that HB  
         1346 do not pass but that CSHB 1346 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent.  Senator Zaffirini moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 2555 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Sibley moved that HB 2555 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent.   
         The Chair laid out HB 2568 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Zaffirini moved that HB 2568 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Zaffirini moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
  
         At 2:35 pm Senator Zaffirini assumed the chair.   
          
         At 2:38 pm Senator Bivins resumed the chair.   
          
         The Chair laid out HB 746 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West sent up Committee Amendment 1 and moved adoption.   
         The motion carried with a vote of 6 ayes, 1 nay, 0 present not  
         voting, and 0 absent.  Senator Zaffirini requested unanimous  
         consent to incorporate the amendment into the bill to create a  
         committee substitute;  without objection, it was so ordered.   
         Senator Zaffirini then moved that the new committee substitute  
         be adopted; without objection, it was so ordered.  Senator  
         West moved that HB 746 do not pass but that CSHB 746 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 7  
         ayes, 0 nays, 0 present not voting, and 2 absent. Senator West  
         moved that the bill be recommended for placement on the Local  
         & Uncontested Calendar; without objection, it was so ordered.   
          
         Senator West moved that the minutes from the prior hearing be  
         approved;  there being no objection, the minutes were  
         approved. 
          
         The Chair laid out HB 2867 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West sent up a committee substitute; the Chair  
         recognized Senator West to explain the difference between the  
         committee substitute and the bill as filed.  Senator West  
         moved adoption of the committee substitute, without objection,  
         it was so ordered. Senator West moved that HB 2867 do not pass  
         but that CSHB 2867 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.   
          
         The Chair laid out HB 1869 and recognized the Senate sponsor,  
         Senator Nelson, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Nelson moved that HB 1869 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent.  Senator Nelson moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         At 2:55 pm Senator Zaffirini assumed the chair.   
          
         At 3:00 pm Senator Bivins resumed the chair.   
          
         The Chair laid out HB 889 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  Witnesses testifying and

         Senator Ogden moved that HB 889 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out SB 831 and recognized the author, Senator  
         Bernsen, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator West  
         moved to withdraw Committee Amendment 1;  there being no  
         objection the amendment was withdrawn.  Senator West sent up  
         Committee Amendment 1 and moved adoption; without objection,  
         the amendment was adopted.  Senator Zaffirini requested  
         unanimous consent to incorporate the amendment into the bill  
         to create a committee substitute;  without objection, it was  
         so ordered.  Senator Zaffirini then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Zaffirini moved that SB 831 do not pass but  
         that CSSB 831 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.   
          
         The Chair laid out SB 876 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Sibley sent up a  
         committee substitute; the Chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Sibley moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Zaffirini sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Zaffirini requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Zaffirini then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Zaffirini moved that SB 876 do not pass but  
         that CSSB 876 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.   
          
         The subcommittee report on SB 1780 was laid out by Senator  
         West.  Senator West moved that SB 1780 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         The subcommittee report on HB 368 was laid out by Senator  
         West.  Senator West moved that HB 368 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
  
         present not voting, and 2 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The subcommittee report on CSHB 1297 was laid out by Senator  
         West.  Senator West moved that CSHB 1297 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The subcommittee report on HB 1840 was laid out by Senator  
         West.  The Chair moved that HB 1840 be left pending; without  
         objection, it was so ordered. 
         The subcommittee report on HB 2622 was laid out by Senator  
         West.  Senator West moved that HB 2622 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The subcommittee report on HB 2664 was laid out by Senator  
         West.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The Chair moved that HB 2664 be  
         left pending; without objection, it was so ordered. 
          
         There was no action taken on HB 585 by West/Lucio. 
          
         There being no further business, at 4:30 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
