         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 21, 1999 in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 12:55 pm.  There  
         being a quorum present, the following business was transacted.   
          
         The Chair laid out SB 980 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Cain moved that SB 980 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 6 ayes, 1 nay, 0 present not  
         voting, and 2 absent.   
          
         The Chair laid out SB 1561 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator West sent up  
         Committee Amendment 1 and moved adoption; without objection,  
         the amendment was adopted.  Senator West sent up Committee  
         Amendment 2 and moved adoption; without objection, the  
         amendment was adopted.  Senator West requested unanimous  
         consent to incorporate amendments into the bill to create a  
         committee substitute;  without objection, it was so ordered.   
         Senator West then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator West  
         moved that SB 1561 do not pass but that CSSB 1561 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 6 ayes, 1 nay,  
         0 present not voting, and 2 absent.   
          
         The Chair laid out SB 1213 and recognized the author, Senator  
  
         Whitmire, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Zaffirini sent up a committee substitute; the Chair  
         recognized Senator Whitmire to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Zaffirini moved adoption of the committee substitute, without  
         objection, it was so ordered.  Senator West moved that SB 1213  
         do not pass but that CSSB 1213 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a vote of 7 ayes, 0 nays, 0 present not  
         voting, and 2 absent.   
          
         The Chair laid out SB 1288 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Bivins moved that SB 1288 be left pending; without  
         objection, it was so ordered. 
          
         At 2:00 pm Senator Zaffirini assumed the chair.   
          
         The Chair laid out CSSB 4 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins moved that CSSB 4  
         be left pending; without objection, it was so ordered.

         The Committee reconvened at 2:45 pm. 
          
         At 2:45 pm Senator Zaffirini assumed the chair.

         Bivins, to explain the bill. Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.

         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Sibley moved that SB 3 do not

         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.

         Senator Zaffirini sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Zaffirini requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Zaffirini then moved that the new  
  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Zaffirini moved that SB 502 do not pass but  
         that CSSB 502 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 6 ayes, 0 nays, 0 present not voting,  
         and 3 absent.  Senator West moved that the bill be recommended  
         for placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
          The Chair laid out SB 510 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Witnesses testifying and

         ordered.  Senator West moved that SB 510 do not pass but that

         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 2 absent.  Senator West moved that the bill be recommended  
         for placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Committee then reconsidered the vote by which SB 510 by  
         Shapleigh was reported favorably as substituted;  the final  
         consideration of the bill is as follows. 
          
         The Chair moved to withdraw the previously adopted amendment  
         to SB 510 by Shapleigh;  there being no objection, the  
         amendment was withdrawn.  Senator West sent up Committee  
         Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Senator West requested unanimous  
         consent to incorporate the amendment into the bill to create a  
         committee substitute;  without objection, it was so ordered.   
         Senator West then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator West  
         moved that SB 510 do not pass but that CSSB 510 be reported
