         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 14, 1999 in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 12:45 pm.  There  
         being a quorum present, the following business was transacted.   
          
         Senator West moved that the minutes from the prior hearing be  
         approved;  there being no objection, the minutes were  
         approved. 
          
         The Chair laid out SB 1227 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Nelson sent up a  
         committee substitute; the Chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Nelson moved adoption of the  
         committee substitute, without objection, it was so ordered.  
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Bivins moved that SB 1227 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1561 and recognized the author, Senator  
         Barrientos, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Bivins moved that SB 1561 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1572 and recognized the author, Senator  
         West, to explain the bill.  Senator Ratliff sent up a  
         committee substitute; the Chair recognized Senator West to  
         explain the difference between the committee substitute and  
  
         the bill as filed.  Senator Ratliff moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator West sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator West  
         requested unanimous consent to incorporate amendments into the  
         committee substitute;  without objection, it was so ordered.   
         Senator West then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator West  
         moved that SB 1572 do not pass but that CSSB 1572 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 8 ayes, 0 nays,  
         0 present not voting, and 1 absent.  Senator Ratliff moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 1352 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1352 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator West moved that SB 1352 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 820 and recognized Senator Zaffirini, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Bivins moved that SB 820 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1455 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Bivins moved that SB 1455 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 724 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the Chair recognized Senator Zaffirini  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         The Chair moved that SB 724 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Zaffirini moved that SB 724 do not pass but  
         that CSSB 724 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 8 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Ratliff moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered. 
          
         The Chair laid out SB 1784 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1784 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Zaffirini moved that SB 1784 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.   
          
         The Chair laid out SB 268 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Ogden sent up a committee  
         substitute; the Chair recognized Senator Ogden to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Ogden moved adoption of the committee  
         substitute, without objection, it was so ordered.  The Chair  
         moved that SB 268 be left pending to await a quorum; without  
         objection it was so ordered.  Upon arrival of a quorum,  
         Senator Ogden moved that SB 268 do not pass but that CSSB 268  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 8  
         ayes, 0 nays, 0 present not voting, and 1 absent.  Senator  
         Ogden moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The Chair laid out SB 516 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and

         Chair moved that SB 516 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a

         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.   
          
         At 4:20 pm Senator Zaffirini assumed the chair.   
          
         At 4:30 pm Senator Bivins resumed the chair.

         the absence of the author, to explain the bill.  Witnesses

         pending; without objection, it was so ordered.

         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator West moved that SB 858 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 8 ayes, 0 nays, 0 present  
         not voting, and 1 absent.   
          
         At 4:55 pm Senator Ogden assumed the chair.   
          
         The Chair laid out SB 910 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Ogden moved that SB 910 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 576 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Ogden sent up a  
         committee substitute; the Chair recognized Senator Armbrister  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Ogden moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  Senator Ogden moved that SB 576 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1724 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator Ogden sent up Committee  
         Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Witnesses testifying and registering  
         on the bill are shown on the attached list.  The Chair moved  
         that SB 1724 be left pending to await a quorum; without  
         objection it was so ordered.  Upon arrival of a quorum,  
         Senator Ogden requested unanimous consent to incorporate the  
         amendment into the bill to create a committee substitute;   
         without objection, it was so ordered.  Senator Cain then moved  
         that the new committee substitute be adopted; without  
         objection, it was so ordered.  Senator Cain moved that SB 1724  
         do not pass but that CSSB 1724 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a vote of 8 ayes, 0 nays, 0 present not  
         voting, and 1 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out SB 1089 and recognized Senator Ogden, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Ogden moved that SB 1089 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1091 and recognized Senator Ogden, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Ogden moved that SB 1091 be left  
         pending; without objection, it was so ordered. 
  
         The Chair moved that the committee stand at ease at 6:15 pm. 
          
         The Committee reconvened at 6:35 pm. 
          
         At 6:35 pm Senator Bivins resumed the chair.   
          
         There was no action taken on SJR 38 by Ratliff. 
          
         The subcommittee report on SB 993 was laid out by Senator  
         West.  Senator West moved that SB 993 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent. Senator Ogden moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The subcommittee report on SB 1059 was laid out by Senator  
         West. Senator West moved that SB 1059 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent. Senator Ratliff moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The subcommittee report on SB 1261 was laid out by Senator  
         West.  Senator West moved that SB 1261 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent. Senator Ratliff moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The subcommittee report on CSSB 1363 was laid out by Senator  
         West.  Senator West moved that CSSB 1363 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator Ratliff moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The subcommittee report on CSSB 1527 was laid out by Senator  
         West.  Senator West moved that CSSB 1527 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         There was no action taken on SB 1104 by Brown 
          
         There being no further business, at 6:55 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
