                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to requiring certain plats for the subdivision of land to
 1-2     include proof of groundwater supply.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter A, Chapter 212, Local Government Code,
 1-5     is amended by adding Section 212.0101 to read as follows:
 1-6           Sec. 212.0101.  ADDITIONAL REQUIREMENTS:  USE OF GROUNDWATER.
 1-7     (a)  If a person submits a plat for the subdivision of a tract of
 1-8     land for which the source of the water supply intended for the
 1-9     subdivision is groundwater under that land, the municipal authority
1-10     responsible for approving plats by ordinance may require the plat
1-11     application to have attached to it a statement that:
1-12                 (1)  is prepared by an engineer registered to practice
1-13     in this state; and
1-14                 (2)  certifies that adequate groundwater is available
1-15     for the subdivision.
1-16           (b)  The Texas Natural Resource Conservation Commission by
1-17     rule shall establish the appropriate form and content of a
1-18     certification to be attached to a plat application under this
1-19     section.
1-20           SECTION 2.  Subchapter A, Chapter 232, Local Government Code,
1-21     is amended by adding Section 232.0031 to read as follows:
1-22           Sec. 232.0031.  ADDITIONAL REQUIREMENTS:  USE OF GROUNDWATER.
1-23     (a)  If a person submits a plat for the subdivision of a tract of
1-24     land for which the source of the water supply intended for the
 2-1     subdivision is groundwater under that land, the commissioners court
 2-2     of a county by order may require the plat application to have
 2-3     attached to it a statement that:
 2-4                 (1)  is prepared by an engineer registered to practice
 2-5     in this state; and
 2-6                 (2)  certifies that adequate groundwater is available
 2-7     for the subdivision.
 2-8           (b)  The Texas Natural Resource Conservation Commission by
 2-9     rule shall establish the appropriate form and content of a
2-10     certification to be attached to a plat application under this
2-11     section.
2-12           SECTION 3.  This Act takes effect September 1, 1999, and
2-13     applies only to a plat for the subdivision of a tract of land that
2-14     is filed on or after that date.
