DIGEST 

Currently, Texas law requires certain water conservation measures. S.B.
1301 will further regulate water conservation measures required in a county
during a declared drought disaster.  

PURPOSE

As enrolled, S.B. 1301 regulates water conservation measures required in a
county during a declared drought disaster.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 16.055, Water Code, by adding Subsections (g),
(h), and (i), as follows: 

(g) Requires the county to take certain action immediately upon the
declaration of a state of disaster due to drought conditions. 

(h) Requires the person or entity to immediately implement the person's or
entity's water conservation plan, or drought contingency plan, on receipt
of the notice under Subsection (g)(2)(B). 

(i) Provides that nothing in this section prevents a political subdivision
or a person or entity required to develop a water conservation plan under
Section 11.1271 or drought contingency plan under Section 11.1272 from
implementing water conservation measures.   

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Emergency clause.
