Amend the Wilson amendment to CSSB 560 (page 33 of packet) by
striking lines 6-13 and substituting the following:
      Sec. 56.047. TIF GRANTS. (a) This section takes effect only
if SB 4, Acts of the 76th Legislature, Regular Session, 1999,
becomes law and contains a provision that prohibits social
promotion of students who do not pass specified assessment
instruments under Section 39.023, Education Code.
      (b)  Notwithstanding any other provision of law, the Texas
Education Agency, in consultation with the board, shall establish a
grant program under which an eligible child may receive a grant
from the fund to be used to pay the costs of attending a private or
public school that is:
            (1)  chosen by the child's parents; and
            (2)  approved by the commissioner of education in
accordance with rules adopted by the commissioner.
      (c)  A child is eligible for a grant under this section if
the child:
            (1)  is in the third grade, fails to perform
satisfactorily on the third grade reading assessment instrument
under Section 39.023, Education Code, and is retained in the third
grade under Section 28.0211, Education Code;
            (2)  is in the fifth grade, fails to perform
satisfactorily on the fifth grade mathematics and reading
assessment instruments under Section 39.023, Education Code, and is
retained in the fifth grade under Section 28.0211, Education Code;
or
            (3)  is in the eighth grade, fails to perform
satisfactorily on the eighth grade mathematics and reading
assessment instruments under Section 39.023, Education Code, and is
retained in the eighth grade under Section 28.0211, Education Code.
      (d)  The commissioner of education and the board shall
jointly determine the amount of the grant provided under this
section which may not exceed $5,000 per student per year.
      (e)  The school district in which the child attended school
when the child was retained at a grade level under Section 28.0211,
Education Code, shall reimburse the fund for the amount of grant.
The board may adopt rules necessary to implement this subsection.
      (f)  A private or public school that accepts a child's grant
under this section:
            (1)  shall provide the student with transportation
between the child's home and the school; and
            (2)  may not charge the child tuition in excess of the
amount of the grant.
