Amend CSHB 846 by adding a new SECTION, appropriately
numbered, to read as follows:
      SECTION ____.  Chapter 49, Water Code, is amended by adding
Section 49.234 to read as follows:
      Sec. 49.234.  JURISDICTION OF COMMISSION.  (a)  The
commission has jurisdiction over the development of water pollution
control and abatement programs developed by a district.  The
commission shall review the water pollution control and abatement
program of a district to ensure that its objectives are met.
      (b)  Notwithstanding any other law, a groundwater
conservation district that is located in the extraterritorial
jurisdiction of a municipality that has any part of its
extraterritorial jurisdiction in the county in which the district
is located and that is not the county in which the majority of the
territory inside the municipality's corporate boundaries is located
has jurisdiction over water pollution control and abatement
programs and regulation and control of nonpoint source water
pollution within the district's boundaries if:
            (1)  the county has not granted its consent to the
municipality to enforce a water pollution control and abatement
program or regulate or control nonpoint source water pollution in
the county; and
            (2)  the county has granted its consent to the district
to enforce a water pollution control and abatement program or
regulate or control nonpoint source water pollution in the county.
      If a county does not grant consent to either the district or
the municipality, it assumes the authority of and limitations on
the municipality under Section 26.177.
      (c)  This section does not apply to:
            (1)  a municipality located in a county in which a
subsidence district is located; or
            (2)  a municipality with a population of less than
160,000 that is located in two counties.
