Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on
International Relations, Trade & Technology was held on
Wednesday, April 30, 1997 in Lt. Governor's Committee Room, at
Austin, Texas.

Chairman Truan called the public meeting to order at 2:21 p.m.
There being a quorum present, the following business was
transacted.
At 2:21 p.m. Senator Sibley assumed the chair and laid out SB
1041, recognizing the Senate sponsor, Senator Truan to explain
the bill. A discussion followed. Witnesses registering on
the bill are shown on the attached list. At 2:25 p.m.
Vice-Chairman Carona assumed the chair and recognized Senator
Truan for a motion that SB 1041 be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. By unanimous consent of the Committee, the vote was
left open for the duration of the hearing. When the vote was
closed at the end of the hearing, the motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 3 absent.
Senator Carona moved that the bill be certified for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 2:27 p.m. Senator Truan resumed the chair and laid out HB
1299, recognizing the Senate sponsor, Senator West, to explain
the bill. A discussion followed. Senator Sibley moved that
HB 1299 be reported favorably to the full Senate with the
recommendation that it do pass and be printed. By unanimous
consent of the Committee, the vote was left open for the
duration of the hearing. When the vote was closed at the end
of the hearing, the motion carried with a vote of 6 ayes, 0
nays, 0 present not voting, and 3 absent. Senator Carona
moved that HB 1299 be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
Chairman Truan laid out HB 2569 and recognized Senator Sibley,
on behalf of Senator Ratliff, to explain the bill. A
discussion followed. Senator Sibley moved that HB 2569 be
reported favorably to the full Senate with the recommendation
that it do pass and be printed. By unanimous consent of the
Committee, the vote was left open for the duration of the
hearing. When the vote was closed at the end of the hearing,
the motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 3 absent. Senator Sibley moved that HB 2569
be certified for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
Senator Ogden requested permission to register his "aye" votes
on SB 1041 and HB 1299; without objection, Chairman Truan
ordered his votes recorded by the clerk.
The Chair laid out HB 3478 and recognized the Senate sponsor,
Senator Ellis, to explain the bill. A discussion followed.
Senator Truan requested that HB 3478 be left pending before
the full Committee. There were no objections to doing so.
Chairman Truan recognized Senator Shapleigh, Chairman of a
Subcommittee on Federal Peace Officers' Authority which
included Senator Truan, Senator Ogden and himself, to lay out
a Subcommittee report on HB 870. Senator Shapleigh announced
that the Subcommittee had approved a Committee Substitute for
HB 870 by a 3-0 vote, and moved adoption of the subcommittee
report; without objection, it was so ordered.
The Chair laid out HB 2138 and recognized Senator Shapleigh,
on behalf of Senator Cain, to explain the bill. A discussion
followed. Witnesses registering on the bill are shown on the
attached list. Senator Shapleigh moved that HB 2138 be
reported favorably to the full Senate with the recommendation
that it do pass and be printed. By unanimous consent of the
Committee, the vote was left open for the duration of the
hearing. When the vote was closed at the end of the hearing,
the motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 3 absent. Senator Shapleigh moved that HB
2138 be certified for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
Chairman Truan recognized Senator Shapleigh to explain CSHB
870. A discussion followed. Senator Shapleigh moved that
CSHB 870 be reported favorably to the full Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 3 absent.
At 2:45 p.m. Senator Carona assumed the chair and laid out SB
813, recognizing Senator Truan to explain the bill. Senator
Truan sent up a Committee Substitute; without objection, it
was adopted. A discussion followed. Senator Truan moved that
CSSB 813 be reported favorably to the full Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 5 ayes, 0 nays, 0 present not voting,
and 4 absent. Senator Truan moved that CSSB 813 be certified
for placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
At 2:50 p.m. Senator Truan resumed the Chair and announced
that HB 1880 would not be taken up at today's Committee
hearing. Chairman Truan brought up HB 3478 to take public
testimony. Witnesses registering and testifying on the bill
are shown on the attached list. Senator Truan moved that HB
3478 be left pending; without objection, it was so ordered.
Senator Carona moved to adopt the minutes from the previous
Committee hearing; without objection, it was so ordered.
The Chair closed and announced the votes on SB 1041, HB 1299,
HB 2569 and HB 2138. There being no further business, at 2:59
p.m. Senator Carona moved that the Committee stand recessed
subject to the call of the Chair; without objection, it was so
ordered.
