Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Criminal
Justice was held on Tuesday, March 4, 1997 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:05 am. There
being a quorum present, the following business was
transacted.
The following members arrived after the roll was called:
none.
SB 46 by Shapiro
The Chair laid out SB 46 and recognized the author, Senator
Shapiro, to explain the bill.
Wayne Scott, representing Texas Department of Criminal
Justice, testified on the bill.
Robert Kepple, representing Texas District and County
Attorneys Association, testified on the bill.
Senator Shapiro sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Shapiro moved that SB 46, as amended, be reported
back to the Senate with the recommendation that it do pass
and be printed. The motion carried with a vote of 5 ayes,
0 nays, 0 present not voting, and 0 absent.
SB 51 by Shapiro
The Chair laid out SB 51 and recognized the author, Senator
Shapiro, to explain the bill.
There being no witnesses signed up to testify on SB 51
public testimony was closed.
Senator Shapiro moved that SB 51 be reported favorably to
the full Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 5 ayes, 0
nays, 0 present not voting, and 0 absent.
Senator Shapiro requested unanimous consent to certify the
bill for Local & Uncontested Calendar; without objection,
it was so ordered.
SB 674 by Brown
The Chair laid out SB 674 and recognized the author,
Senator Brown, to explain the bill.
Jerome Aldrich, representing Brazoria County , testified in
favor of the bill.
Senator West moved that SB 674 be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 5 ayes, 0 nays,
0 present not voting, and 0 absent.
SB 467 by Nelson
The Chair laid out SB 467 and recognized the author,
Senator Nelson, to explain the bill.
Ben Flanagan, representing Grapevine Police Department,
testified in favor of the bill.
Mark Clark, representing CLEAT, registered but did not
testify in favor of the bill.
Senator Nelson moved that SB 467 be reported favorably to
the full Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 5 ayes, 0
nays, 0 present not voting, and 0 absent.
Senator Nelson requested unanimous consent to certify the
bill for Local & Uncontested Calendar; without objection,
it was so ordered.
There being no further business, at 9:44 am Senator
Whitmire moved that the Committee stand recessed subject to
the call of the Chair. Without objection, it was so
ordered.
