         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Tuesday, April 29, 1997 in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 1:50 pm.  There being  
         a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         none. 
          
         The Chair laid out HB 1137 and recognized the Senate sponsor,  
         Senator Brown, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Public testimony was closed. 
          
         Senator Nixon moved that HB 1137 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 13 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Nixon moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar, without objection, it was  
         so ordered.   
          
         At 1:55 pm Senator Nixon assumed the chair.   
          
         The Chair laid out HB 1782 and recognized the Senate sponsor,  
         Senator Truan, to explain the bill.

         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Galloway moved adoption of the committee substitute,  
         without objection, it was so ordered.

         adoption; without objection, the amendment was adopted.

         adoption; without objection, the amendment was adopted.

         and then withdrew it. 
          
         Senator Galloway sent up Committee Amendment 3 and moved  
         adoption.  There being objection, the amendment failed to  
         adopt with a vote of 1 aye, 12 nays, 0 present not voting, and  
         0 absent.

         Senator Gallegos submitted the Subcommittee Report on SB 371  
         and moved adoption, without objection, the report was adopted. 
          
         Senator Shapiro sent up a Committee Substitute. 
          
         Senator Gallegos sent up Committee Amendment 1 and moved  
         adoption, without objection, the amendment was adopted.   
         Senator Galloway sent up Committee Amendment 2 and moved  
         adoption, without objection, the amendment was adopted.   
         Senator Gallegos sent up Committee Amendment 3 and moved  
         adoption, without objection, the amendment was adopted.   
         Senator Gallegos sent up Committee Amendment 4 and moved  
         adoption, without objection, the amendment was adopted.  
          
         Senator Armbrister sent up Committee Amendment 5 and then  
         pulled the amendment down. 
          
         Senator Gallegos moved that CSSB 371, as amended, be adopted;  
         without objection, the substitute, as amended, was adopted. 
          
         Senator Gallegos moved that the amendments be rolled into the  
  
         body of the committee substitute, without objection, the  
         motion prevailed.    
          
         The Chair brought up HB 1782 from pending business.  Senator  
         Nixon moved that HB 1782 be reported favorably to the full  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 13 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         The Chair brought up HB 1955 from pending business.  Senator  
         Nelson moved that HB 1955 be reported favorably to the full  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 13 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         Senator Gallegos, Jr. moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.

         Fraser moved that SB 1328, as amended, be reported favorably  
         to the full Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 13 ayes, 0  
         nays, 0 present not voting, and 0 absent.   
          
         The Chair brought up HB 1387 from pending business.  Senator  
         Armbrister moved that HB 1387, as amended,  be reported  
         favorably to the full Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 13  
         ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Armbrister moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.

         Cain moved that HB 35 be reported favorably to the full Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a vote of 13 ayes, 0 nays, 0 present not  
         voting, and 0 absent.     
          
         Senator Cain moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar, without objection, it was  
         so ordered.   
          
         The Chair brought up HB 1532 from pending business.  Senator  
         Nelson moved that HB 1532 be reported favorably to the full  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 13 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         The Chair brought up HB 327 from pending business.  Senator  
         Gallegos moved that HB 35 be reported favorably to the full  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 13 ayes, 0 nays, 0 present  
  
         not voting, and 0 absent.   
          
         Senator Gallegos moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.    
          
         The Chair brought up SB 371 from pending business.  Senator  
         Armbrister moved that SB 371 do not pass but that CSSB 371 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 13  
         ayes, 0 nays, 0 present not voting, and 0 absent. 
          
         At 3:15 pm Senator Armbrister resumed the chair.   
          
         No action was taken on HB 670.  
          
         The Chair advised that SB 1701  had been tagged pursuant to  
         Senate Rule 11.20 and would not be heard. 
          
         There being no further business, at 3:20 pm Senator Armbrister  
         moved that the Committee be adjourned. Without objection, it  
         was so ordered.
