         Pursuant to a notice posted in accordance with Senate Rule 
         11.11, a public hearing of the Senate Committee on State Affairs 
         was held on Tuesday, March 4, 1997 in the Senate Chamber at 
         Austin, Texas.

         The Chair called the meeting to order at 2:00 pm.  There being 
         a quorum present, the following business was transacted.  
         
         The following members arrived after the roll was called:  none.
         
         The Chair laid out SB 487 and recognized the author, Senator 
         Zaffirini, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.  
         
         Senator Nelson moved that SB 487 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 10 ayes, 0 nays, 0 
         present not voting, and 3 absent.  
         
         Senators Fraser, Gallegos and Whitmire requested unanimous 
         consent to be shown voting aye on SB 487.  There being no 
         objection, the motion prevailed.
         
         Senator Nelson requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair brought up CSSB 255 from pending business.  Senator 
         Carona moved that CSSB 255 be reported favorably to the full 
         Senate with the recommendation that it do pass and be printed. 
         The motion carried with a vote of 9 ayes, 0 nays, 0 present not 
         voting, and 4 absent.  
         
         Senators Fraser, Gallegos, Luna and Whitmire requested unanimous 
         consent to be shown voting aye on CSSB 255.  There being no 
         objection, the motion prevailed.
         
         The Chair laid out SB 626 and recognized the author, Senator 
         Sibley, to explain the bill.

         Senator Shapiro moved that SB 626 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 9 ayes, 0 nays, 0 
         present not voting, and 4 absent.  
         
         Senators Fraser, Gallegos, Luna and Whitmire requested unanimous 
         consent to be shown voting aye on SB 626.  There being no 
         objection, the motion prevailed.
         
         Senator Shapiro requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 627 and recognized the author, Senator 
         Sibley, to explain the bill.

         Senator Armbrister moved that SB 627 be left pending; without 
         objection, it was so ordered.
         
         The Chair laid out SB 536 and recognized the author, Senator 
         Ogden, to explain the bill.

         the attached list.  
         
         Senator Carona sent up Committee Amendment 1 and Senator Ogden 
         explained it.  Senator Carona moved adoption; without objection, 
         the amendment was adopted.
         
         Senator Carona moved that SB 536 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 12 ayes, 0 nays, 0 
         present not voting, and 1 absent.  
         
         Senator Gallegos requested unanimous consent to be shown voting 
         aye on SB 536.  There being no objection, the motion prevailed.
         
         The Chair laid out SB 446 and recognized the author, Senator 
         Haywood, to explain the bill.  
         
         Senator Shapiro sent up CSSB 446 and moved adoption, without 
         objection, the committee substitute was adopted.

         Senator Nelson moved that CSSB 446 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 12 ayes, 0 nays, 0 
         present not voting, and 1 absent.  
         
         Senator Gallegos requested unanimous consent to be shown voting 
         aye on CSSB 446.  There being no objection, the motion 
         prevailed.
         
         The Chair laid out SB 308 and recognized the author, Senator 
         Wentworth, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on

         Senator Cain sent up Committee Amendment 1 and moved adoption. 
         The motion failed by a vote of 5 ayes, 5 nays, 0 present not 
         voting, and 3 absent.  
         
         Senator Nelson moved that SB 308  be reported back to the Senate
 
         





         with the recommendation that it do pass and be printed.  The 
         motion carried with a vote of 10 ayes, 2 nays, 0 present not 
         voting, and 1 absent.  
         
         The Chair laid out SB 82 and recognized the author, Senator 
         Ellis, to explain the bill.  
         
         Senator Ellis moved that SB 82 be reported favorably to the full 
         Senate with the recommendation that it do pass and be printed. 
         The motion carried with a vote of 11 ayes, 0 nays, 0 present not 
         voting, and 2 absent.  
         
         Senators Fraser and Whitmire requested unanimous consent to be 
         shown voting aye on SB 82.  There being no objection, the motion 
         prevailed.
         
         The Chair laid out SB 394 and recognized the author, Senator 
         Ellis, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.  
         
         At 3:45 pm Senator Nixon assumed the chair.  
         
         Senator Ellis sent up Amendment 1 and moved adoption; with 
         objection, the amendment was adopted.
         
         Senator Nelson moved that SB 394 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0 
         present not voting, and 2 absent.  
         
         Senators Fraser and Whitmire requested unanimous consent to be 
         shown voting aye on SB 394.  There being no objection, the 
         motion prevailed.
         
         Senator Ellis requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 509 and recognized Senator Armbrister, in 
         the absence of Senator Madla, to explain the bill.

         Senator Armbrister sent up CSSB 509 and  moved adoption, without 
         objection, the committee substitute was adopted.
         
         Senator Armbrister moved that CSSB 509 be left pending; without 
         objection, it was so ordered.
         
         The Chair laid out SB 672 and recognized the author, Senator 
         Armbrister, to explain the bill.  
         
         Senator Armbrister moved that SB 672 be reported favorably to 
         the full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0 
         present not voting, and 2 absent.  
         
         Senator Armbrister requested unanimous consent to certify the 
         bill for Local & Uncontested Calendar; without objection, it was 
         so ordered.  
         
         At 4:00 pm Senator Armbrister resumed the chair.  
         
         There being no further business, at 4:05 pm Senator Armbrister 
         moved that the Committee stand recessed subject to the call of
