         Pursuant to a notice posted in accordance with Senate Rule 
         11.11, a public hearing of the Senate Committee on State Affairs 
         was held on Tuesday, February 18, 1997 in the Capitol Building, 
         Room 2E.20, at Austin, Texas.

         The Chair called the meeting to order at 1:35 pm.  There being 
         a quorum present, the following business was transacted.  
         
         The following members arrived after the roll was called:  none.
         
         At 1:35 pm Senator Nixon assumed the chair.  
         
         The Chair laid out SB 438 and recognized the author, Senator 
         Armbrister, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.  
         
         Senator Armbrister sent up a committee substitute; the Chair 
         recognized Senator Armbrister to explain the difference between 
         the committee substitute and the bill as filed.  
         
         Senator Armbrister moved that SB 438 do not pass but that CSSB 
         438 be reported back to the Senate with the recommendation that
 
         





         it do pass and be printed.  There being no objection, it was so 
         moved.  
         At 1:45 pm Senator Armbrister resumed the chair.  
         
         The Chair laid out SB 237 and recognized the author, Senator 
         Nixon, to explain the bill.
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.   
         
          Senator Ellis sent up Committee Amendment 1 and moved adoption; 
         without objection, the amendment was adopted.  
         
         Senator Nixon moved that SB 237, as amended, be reported back to 
         the Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 11 ayes, 1 nay, 0 
         present not voting, and 1 absent.  
         
         The Chair laid out SB 343 and recognized the author, Senator 
         Harris, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.  
         
         Senator Armbrister moved that SB 343 be left pending; without 
         objection, it was so ordered.
         
         The Chair laid out SB 238 and recognized the author, Senator 
         Nixon, to explain the bill.  
         
         Witnesses testifying and registering on the bill are shown on 
         the attached list.  
         
         Senator Nixon moved that SB 238 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 13 ayes, 0 nays, 0 
         present not voting, and 0 absent.  
         
         The Chair asked that SB 292 be brought from the table and 
         recognized its author, Senaor Carona to explain the bill.  The 
         witnesses for SB 292 had testified at the previous meeting on 
         2/11/97.
         
         Senator Carona moved that SB 292 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 13 ayes, 0 nays, 0 
         present not voting, and 0 absent.
