         Pursuant to a notice posted in accordance with Senate Rule 
         11.11, a public hearing of the Senate Committee on 
         Jurisprudence was held on Monday, March 17, 1997 in the Senate 
         Chamber at Austin, Texas.

         The Chair called the meeting to order awaiting a quorum at 
         2:00 pm. 
         
         The Chair laid out SB 711 and recognized the author, Senator 
         Harris, to explain the bill.  
         The Chair moved that SB 711 be left pending to await a quorum; 
         without objection it was so ordered.
         
         The Chair laid out SB 287 and recognized the author, Senator 
         Haywood, to explain the bill.  Witnesses testifying and 
         registering on the bill are shown on the attached list.
         
         The roll was called all members being present, the following 
         business was transacted.
           
         Upon arrival of the quorum Senator Harris sent up Committee 
         Amendment 1 and moved adoption; without objection, the 
         amendment was adopted.  
         Senator Harris moved that SB 287, as amended, be reported back 
         to the Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0 
         present not voting, and 0 absent.  Senator Harris requested 
         unanimous consent to certify the bill for Local & Uncontested 
         Calendar; without objection, it was so ordered.  
         
         The Chair laid out SB 884 and recognized the author, Senator 
 
         





         Harris, to explain the bill.  
         Witnesses testifying and registering on the bill are shown on

         Senator Harris moved that SB 884 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0 
         present not voting, and 0 absent. 
         Senator Harris requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 34 and recognized the author, Senator 
         Zaffirini, to explain the bill.

         Senator Ellis moved that SB 34 be left pending; without 
         objection, it was so ordered.
         
         The chair laid out SB 711, Senator Harris moved that SB 711 be 
         reported back to the senate with the recommendation that it do 
         pass and be printed.  The motion carried with a vote of 6 
         ayes, 0 nays, 0 present not voting, and 1 absent. 
         Senator Harris requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 902 and recognized Senator Cain, in the 
         absence of the author, to explain the bill.

         Senator Cain moved that SB 902 be reported favorably to the 
         full Senate with the recommendation that it do pass and be 
         printed.  The motion carried with a vote of 6 ayes, 0 nays, 0

         Senator Harris requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 506 and recognized the author, Senator 
         Harris, to explain the bill.  
         Senator Harris sent up a committee substitute; the Chair 
         recognized Senator Harris to explain the difference between 
         the committee substitute and the bill as filed.  
         Senator Harris then moved that the committee substitute be 
         adopted; without objection, it was adopted.

         Senator Harris sent up Committee Amendment 1 and moved 
         adoption; without objection, the amendment was adopted.  
         Senator Harris requested unanimous consent to incorporate the 
         amendment into the committee substitute;  without objection, 
         it was so ordered. 
         
         Senator Harris moved that SB 506 do not pass but that CSSB 506 
         be reported back to the Senate with the recommendation that it 
 
         





         do pass and be printed.  The motion carried with a vote of 7 
         ayes, 0 nays, 0 present not voting, and 0 absent.  
         Senator Harris requested unanimous consent to certify CSSB 506 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         Senator Luna requested unanimous consent to be shown voting 
         aye on CSSB 506; without objection, it was so ordered.
         
         The Chair laid out SB 754 and recognized the author, Senator 
         Harris, to explain the bill.

         Senator Harris moved that SB 754 be reported favorably to the 
         full Senate with the recommendation that it do pass and be

         ordered.

         The Chair laid out SB 808 and recognized Senator Wentworth, in 
         the absence of the author, to explain the bill.  
         Witnesses testifying and registering on the bill are shown on

         Senator Wentworth sent up Committee Amendment 1 and moved 
         adoption; without objection, the amendment was adopted.  
         Senator Harris moved that SB 808, as amended, not be reported 
         back to the Senate with the recommendation that it do not pass 
         and be printed.  
         Senator Wentworth made a substitute motion that SB 808, as 
         amended, be reported back to the Senate with the 
         recommendation that it do pass and be printed.
         Senator Wentworth withdrew his substitute motion, and Senator 
         Harris made a substitute motion that SB 808, as amended, be 
         left pending.  Without objection, it was so ordered.
         
         Senator Wentworth requested unanimous consent to be shown 
         voting aye on 711, 754, 884, and 902;  without objection, it 
         was so ordered.
         
         At 3:24 pm Senator Cain assumed the chair.  
         
         The Chair laid out SB 712 and recognized the author, Senator 
         Harris, to explain the bill.

         At 3:35 pm Senator Ellis resumed the chair.  
         
         Senator Harris sent up a committee substitute; the Chair 
         recognized Senator Harris to explain the difference between 
         the committee substitute and the bill as filed.  Senator 
         Harris then moved that the committee substitute be adopted; 
         without objection, it was adopted.
         Senator Harris sent up Committee Amendment 1 and moved 
         adoption; without objection, the amendment was adopted.  
         Senator Harris requested unanimous consent to incorporate 
         amendments into the committee substitute; without objection, 
         it was so ordered.   
         Senator Harris moved that SB 712 do not pass but that CSSB 712 
         be reported back to the Senate with the recommendation that it 
         do pass and be printed.  The motion carried with a vote of 4 
         ayes, 0 nays, 1 present not voting, and 2 absent.
         Senator Harris requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.

         Senator Harris requested unanimous consent to certify the bill 
         for Local & Uncontested Calendar; without objection, it was so 
         ordered.  
         
         The Chair laid out SB 453 and recognized the author, Senator 
         Duncan, to explain the bill.

         Senator Duncan sent up a committee substitute; the Chair 
         recognized Senator Duncan to explain the difference between 
         the committee substitute and the bill as filed.  Senator 
         Duncan then moved that the committee substitute be adopted; 
         without objection, it was adopted.
         Senator Duncan moved that SB 453 do not pass but that CSSB 453 
         be reported back to the Senate with the recommendation that it 
         do pass and be printed. The motion carried with a vote of 5 
         ayes, 0 nays, 0 present not voting, and 2 absent. 
         
         There being no further business, at 4:00 pm Senator Ellis 
         moved that the Committee stand recessed subject to the call of
