         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, May 7, 1997 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:05 am. The  
         following business was transacted.   
          
         The Chair laid out HB 2812 and recognized the Senate sponsor,  
         Senator Gallegos, Jr., to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that HB 2812 be left pending  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Barrientos moved HB 2812 be  
         reported back to the senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 11  
         ayes, 0 nays, 0 present not voting, and 0 absent.  Senator  
         Barrientos moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar, without objection, it was so  
         ordered.   
          
         At 9:10 am Senator West assumed the chair.   
          
         The Chair laid out HB 385 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  The Chair moved that HB  
         385 be left pending to await a quorum; without objection it  
         was so ordered.  Upon arrival of a quorum, Senator Fraser  
         moved HB 385 be reported back to the senate with the  
         recommendation that it do pass and be printed.  The motion  
  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent.  Senator Fraser moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         The Chair laid out HB 722 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 722 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Galloway moved HB 722 be reported back to the  
         senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         At 9:30 am Senator Luna assumed the chair.   
          
         The Chair laid out HB 1460 and recognized the Senate sponsor,  
         Senator Fraser, to explain the bill.  The Chair moved that HB  
         1460 be left pending to await a quorum; without objection it  
         was so ordered.  Upon arrival of a quorum, Senator Zaffirini  
         moved HB 1460 be reported back to the senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent.  Senator Zaffirini moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         The Chair laid out HCR 64 and recognized Senator Shapleigh, in  
         the absence of the Senate sponsor, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The Chair moved that HCR 64 be left  
         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Zaffirini moved  
         HCR 64 be reported back to the senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 11 ayes, 0 nays, 0 present not voting, and 0 absent.   
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out HB 3356 and recognized the Senate sponsor,  
         Senator Barrientos, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         The Chair moved that HB 3356 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Barrientos moved HB 3356 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.  Senator Barrientos moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1872 and recognized Senator Barrientos,  
         in the absence of the author, to explain the bill.  Witnesses  
  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1872 be left pending  
         and the testimony remain open until the committee reconvened  
         after adjournment of the Senate's daily session; without  
         objection, it was so ordered. 
          
         At 10:55 am the committee recessed until 30 minutes after  
         adjournment of the Senate's daily session. 
          
         At 12:50 pm the committee reconvened. 
          
         At 12:50 pm Senator Bivins resumed the chair.   
          
         At this time SB 1872 was laid on the table. 
          
         The Chair laid out SB 1019 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Haywood sent up a  
         committee substitute; the Chair recognized Senator Ogden to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Haywood moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Haywood sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The Chair moved that SB 1019 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out HB 1989 and recognized Senator Zaffirini,  
         in the absence of the Senate sponsor, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Zaffirini moved that HB 1989 be  
         reported favorably to the full Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 11 ayes, 0 nays, 0 present not voting, and 0 absent.   
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At this time, SB 1872 was brought back up so that testimony  
         could resume. The Chair moved that SB 1872 be left pending;  
         without objection, it was so ordered. 
          
         There being no further business, at 1:40 pm the Chair moved  
         that the Committee stand recessed subject to the call of the  
         Chair.  Without objection, it was so ordered.
