         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 16, 1997 in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:05 am. The  
         following business was transacted.   
          
         The Chair laid out SB 963 and recognized the author, Senator  
         Shapiro, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 963 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum,  Senator Luna sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Luna requested unanimous consent to incorporate  
         amendments into the bill to create a new committee substitute.   
         Senator Luna then moved that the new committee substitute be  
         adopted.  Senator Luna moved that SB 963 do not pass but that  
         CSSB 963 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 10 ayes, 1 nay, 0 present not voting,  
         and 0 absent.   
          
         The Chair laid out SB 1185 and recognized the author, Senator  
         Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1185 be left pending; without objection,  
         it was so ordered. 
  
         The Chair laid out SB 1034 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Barrientos sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  
         Senator Barrientos requested unanimous consent to incorporate  
         amendments into the bill to create a new committee substitute;  
         without objection, it was so ordered. The Chair moved that SB  
         1034 be left pending to await a quorum; without objection it  
         was so ordered.  Upon arrival of a quorum, Senator Barrientos  
         moved that SB 1034 do not pass but that CSSB 1034 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 11 ayes, 0  
         nays, 0 present not voting, and 0 absent.  Senator Barrientos  
         moved that the bill be recommended for placement on the Local  
         & Uncontested Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1379 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator West sent up a committee  
         substitute; the Chair recognized Senator Ellis to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator West moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1379 be left pending  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Luna moved that SB 1379 do not  
         pass but that CSSB 1379 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent.  Senator Barrientos moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         The Chair laid out SB 1414 and recognized the author, Senator  
         Luna, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1414 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Luna moved SB 1414 be reported back to the  
         senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
         At 10:50 am the committee recessed until 30 minutes after  
         adjournment of the daily session of the Senate. 
          
         At 1:45 pm the committee reconvened. 
         The Chair laid out SB 1040 and recognized Senator Barrientos,  
         in the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1040 be left pending  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Barrientos moved SB 1040 be  
         reported back to the senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 11  
  
         ayes, 0 nays, 0 present not voting, and 0 absent.  Senator  
         Barrientos moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar, without objection, it was so  
         ordered.   
          
         The Chair laid out SCR 42 and recognized Senator Barrientos,  
         in the absence of the author, to explain the bill.  The Chair  
         moved that SCR 42 be left pending to await a quorum; without  
         objection it was so ordered.  Upon arrival of a quorum,  
         Senator Barrientos moved SCR 42 be reported back to the senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a vote of 11 ayes, 0 nays, 0 present not  
         voting, and 0 absent.  Senator Barrientos moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1221 and recognized the author, Senator  
         Luna, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 776 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Luna moved that SB 1221 be left pending;  
         without objection, it was so ordered. 
          
         The Chair laid out SB 776 and recognized the author, Senator  
         Nixon, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 776 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, the Chair moved that SB 776 be left pending; without  
         objection, it was so ordered. 
          
         At 2:50 pm Senator Luna assumed the chair.   
          
         The Chair laid out SB 1206 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         The Chair moved that SB 1206 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Bivins moved that SB 1206 do not pass but  
         that CSSB 1206 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 6 ayes, 4 nays, 0 present not voting,  
         and 1 absent.   
          
         The Chair laid out SB 1907 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Bivins sent up Committee Amendment 1 and moved  
  
         adoption; without objection, the amendment was adopted.   
         Senator Bivins sent up Committee Amendment 2 and moved  
         adoption; without objection, the amendment was adopted.  The  
         Chair moved that SB 1907 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins requested unanimous consent to  
         incorporate amendments into the committee substitute.  Senator  
         Bivins then moved that the new committee substitute be  
         adopted.  Senator Bivins moved that SB 1907 do not pass but  
         that CSSB 1907 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 10 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         At 3:15 pm Senator Bivins resumed the chair.   
          
         At 3:53 pm Senator Luna assumed the chair.   
          
         At 3:55 pm Senator Bivins resumed the chair.   
          
         There was no action taken on SB 198 by Zaffirini. 
          
         There was no action taken on SB 1178 by Gallegos. 
          
         There was no action taken on SB 1189 by Armbrister. 
          
         There was no action taken on SB 1361 by West. 
          
         There was no action taken on SB 1682 by Ratliff.

         There being no further business, at 3:55 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
