         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 9, 1997 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:05 am.  The  
         following business was transacted.   
          
         The Chair laid out SB 1178 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Senator West sent up a  
         committee substitute; the Chair recognized Senator Gallegos,  
         Jr. to explain the difference between the committee substitute  
         and the bill as filed.  Senator West moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator West sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator West requested unanimous consent to  
         incorporate amendments into the committee substitute.  The  
         Chair moved that SB 1178 be left pending at the request of the  
         author; without objection, it was so ordered. 
          
         The Chair laid out SB 1287 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Senator West sent up a  
         committee substitute; the Chair recognized Senator Gallegos,  
         Jr. to explain the difference between the committee substitute  
         and the bill as filed.  Senator West moved adoption of the  
  
         committee substitute, without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The Chair moved that CSSB 1287 be left  
         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Luna moved that SB  
         1287 do not pass but that CSSB 1287 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  Senator Shapleigh moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 433 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  
          
         At 10:20 am the committee recessed until 30 minutes after  
         adjournment of the Senate. 
          
         At 2:35 pm the committee reconvened. 
          
         At 2:35 pm Senator Luna assumed the chair.   
          
         Testimony on SB 433 by Lucio resumed.   
          
         At 2:30 pm Senator Bivins resumed the chair.   
          
         After discussion of several potential Committee Amendments,  
         Senator Shapleigh sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Barrientos moved that SB 433, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 8 ayes, 3 nays,  
         0 present not voting, and 0 absent.   
          
         The Chair laid out SB 1306 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West moved that SB 1306 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out SB 1357 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         At 3:45 pm Senator Luna assumed the chair.   
          
         At 3:50 pm Senator Bivins resumed the chair.   
          
         Senator West moved that SB 1357 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out SB 1359 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the Chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator West moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator West sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
          
         Senator West requested unanimous consent to incorporate

         moved that the new committee substitute be adopted.  Senator  
         West moved that SB 1359 do not pass but that CSSB 1359 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 11  
         ayes, 0 nays, 0 present not voting, and 0 absent.  Senator  
         West moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar, without objection, it was so  
         ordered.   
          
         The Chair laid out SB 1361 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the Chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator West moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator West sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator West requested unanimous consent to incorporate

         The Chair laid out SB 1826 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator Shapleigh sent up a  
         committee substitute; the Chair recognized Senator Shapleigh  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Shapleigh moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  The Chair moved that SB 1826 be left  
         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Shapleigh moved  
         that SB 1826 do not pass but that CSSB 1826 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 10 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator Shapleigh moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar, without objection, it was so ordered.   
          
         At 4:30 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out SB 1368 and recognized Senator Bivins, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1368 be left pending  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Luna moved SB 1368 be reported  
         back to the senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 11 ayes, 0  
         nays, 0 present not voting, and 0 absent.  Senator Shapleigh  
         moved that the bill be recommended for placement on the Local  
         & Uncontested Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1811 and recognized Senator Bivins, in  
         the absence of the author, to explain the bill.  Senator  
         Bivins sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1811 be left pending  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Luna requested unanimous consent  
         to incorporate amendments into the bill to create a committee  
         substitute.  Senator Luna then moved that the new committee  
         substitute be adopted.  Senator Luna moved that SB 1811 do not  
         pass but that CSSB 1811 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a vote of 10 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Galloway moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         At 4:45 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 1627 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1627 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Haywood moved SB 1627 be reported back to the  
         senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  Senator Shapleigh moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar, without objection, it was so ordered.  [Note:   
         During the committee hearing, the chair inadvertently made the  
         motion to vote out a committee substitute on this bill.  There  
         being no substitute on the bill, it was voted out favorably as  
         filed.  Let this correction be duly noted in this official  
         record of committee action.] 
          
         At 4:40 pm Senator Luna assumed the chair.   
          
         The Chair laid out SB 1654 and recognized Senator Bivins, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 1654 be left pending  
  
         to await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator West moved SB 1654 be reported  
         back to the senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 10 ayes, 0  
         nays, 0 present not voting, and 1 absent.  Senator Galloway  
         moved that the bill be recommended for placement on the Local  
         & Uncontested Calendar, without objection, it was so ordered.   
         [Note:  The posting rule was suspended on the Senate floor so  
         that this bill could be heard in committee.] 
          
         At 4:55 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 198 and recognized Senator Barrientos,  
         in the absence of the author, to explain the bill.  Senator  
         Barrientos sent up a committee substitute; the Chair  
         recognized Senator Barrientos to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Barrientos moved adoption of the committee substitute,  
         without objection, it was so ordered.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         The Chair moved that SB 198 be left pending at the request of  
         the author; without objection, it was so ordered. 
          
         The Chair laid out SB 1189 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Barrientos sent up  
         Committee Amendment 1 and moved adoption; without objection,  
         the amendment was adopted.  Senator Luna requested unanimous  
         consent to incorporate amendments into the bill to create a  
         committee substitute.  Senator Luna then moved that the new  
         committee substitute be adopted.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 1189 be left pending at the request of the  
         author; without objection, it was so ordered. 
          
         The Chair laid out SB 1553 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Shapleigh sent up a  
         committee substitute; the Chair recognized Senator Ogden to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Shapleigh moved adoption of the  
         committee substitute, without objection, it was so ordered.

         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Shapleigh moved  
         that SB 1553 do not pass but that CSSB 1553 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.  Senator Haywood moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1703 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and

         Senator Bivins moved that SB 1907 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 522 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that SB 522 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins moved SB 522 be reported back to the  
         senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 1 nay, 0 present not  
         voting, and 1 absent.   
         There was no action taken on SB 1206 by Bivins. 
          
         At 7:15 pm Senator Bivins resumed the chair.   
          
         There being no further business, at 7:30 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
