         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 2, 1997 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:25 am.  The  
         following business was transacted.   
          
         The Chair laid out SB 1158 and recognized the author, Senator  
         Luna, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Fraser moved that SB 1158 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out SB 1356 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the Chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator West moved adoption of the committee  
         substitute, without objection, it was so ordered.  Senator  
         West sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted.  Senator West requested  
         unanimous consent to incorporate amendments into the committee  
         substitute. Witnesses testifying and registering on the bill  
         are shown on the attached list.   Senator West moved that SB  
  
         1356 do not pass but that CSSB 1356 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.  Senator West moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         The Chair laid out SB 338 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West moved that SB 338 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 10 ayes, 0 nays, 0  
         present not voting, and 1 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 717 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator West moved that SB 717 be reported favorably to the  
         full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 10 ayes, 0 nays, 0  
         present not voting, and 1 absent.   
          
         The Chair laid out SB 780 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Shapleigh moved that SB 780 be reported favorably to  
         the full Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 9 ayes, 1 nay, 0  
         present not voting, and 1 absent.   
          
         At 10:40 am Senator Luna assumed the chair.   
          
         The Chair laid out SB 1712 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  Senator Bivins moved that SB 1712 do not  
         pass but that CSSB 1712 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion

         and 1 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         At 10:48 am Senator Bivins resumed the chair.   
          
         At 10:50 am the Chair recessed the committee until 30 minutes  
         after adjournment of the Session. 
          
         At 2:40 pm the committee reconvened. 
          
         At 2:40 pm Senator Fraser assumed the chair.   
          
         The Chair laid out SB 1480 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Bivins sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Bivins sent up Committee Amendment 2 and moved  
         adoption; without objection, the amendment was adopted.  
         Senator Bivins requested unanimous consent to incorporate  
         amendments into the bill to create a committee substitute.   
         Senator Bivins then moved that the new committee substitute be  
         adopted.  Senator Bivins moved that SB 1480 do not pass but  
         that CSSB 1480 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 9 ayes, 0 nays, 0 present not voting,  
         and 2 absent.   
          
          At 3:20 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 1419 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the Chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Zaffirini moved adoption of the committee  
         substitute, without objection, it was so ordered.   
          
         At 4:20 pm Senator Luna assumed the chair.   
          
         At 4:40 pm Senator Bivins resumed the chair.

         the attached list.  Senator West sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator West requested unanimous consent to

         reported back to the Senate with the recommendation that it do  
         pass and be printed. The motion carried with a vote of 10

         At 5:05 pm Senator Zaffirini assumed the chair.

         full Senate with the recommendation that it do pass and be

         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 10  
         ayes, 0 nays, 0 present not voting, and 1 absent.  Senator  
         Bivins moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar, without objection, it was so  
         ordered.   
          
         At 5:15 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 806 and recognized the author, Senator  
         Ogden, to explain the bill. Senator Haywood sent up a  
         committee substitute; the Chair recognized Senator Ogden to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Haywood moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the attached list.  The Chair moved that SB 806 be left  
         pending to await a quorum; without objection it was so  
         ordered. Senator Galloway moved that SB 806 do not pass but  
         that CSSB 806 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  There being  
         objection, the motion carried with a vote of 7 ayes, 1 nay, 0  
         present not voting, and 3 absent.   
          
         At 5:25 pm Senator Zaffirini assumed the chair.   
          
         The Chair laid out SB 1893 and recognized the author, Senator  
         Bivins, to explain the bill. Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.

         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Bivins moved that SB 517 do not pass but that CSSB 517  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 11

         Bivins moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar, without objection, it was so  
         ordered.   
          
         At 5:35 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 462 and recognized the author, Senator  
         Luna, to explain the bill.  Senator Shapleigh moved that SB  
         462 be reported favorably to the full Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 10 ayes, 0 nays, 0 present not voting,  
         and 1 absent.  Senator Luna moved that the bill be recommended  
         for placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At 5:40 pm Senator Luna assumed the chair.   
          
         The Chair laid out SB 1154 and recognized Senator Bivins, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Bivins sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator Bivins requested unanimous consent to  
         incorporate amendments into the committee substitute.  Senator  
         Bivins then moved that the new committee substitute be  
         adopted.  Senator Bivins moved that SB 1154 do not pass but  
         that CSSB 1154 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar,  
         without objection, it was so ordered.   
          
         There was no action taken on SB 1206 by Bivins. 
          
         At 5:45 pm Senator Bivins resumed the chair.   
          
         There being no further business, at 5:45 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
