Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on
Education was held on Wednesday, March 5, 1997 in the
Capitol Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:35 am. The
following business was transacted.
The Chair laid out SB 616 and recognized the author,
Senator Sibley, to explain the bill. Senator Sibley sent
up a committee substitute; the Chair recognized Senator
Sibley to explain the difference between the committee
substitute and the bill as filed. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Sibley moved that CSSB 616 be adopted by the
committee, there being no objection, it was so moved.
Senator Sibley moved that SB 616 do not pass but that CSSB
616 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 10 ayes, 0 nays, 0 present not voting, and 1
absent. Senator Sibley requested unanimous consent to
certify the bill for Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out SB 465 and recognized the author,
Senator Harris, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
Senator Sibley moved that SB 465 be reported favorably to
the full Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 11 ayes, 0
nays, 0 present not voting, and 0 absent. Senator Sibley
requested unanimous consent to certify the bill for Local &
Uncontested Calendar; without objection, it was so ordered.
The Chair laid out SB 312 and recognized the author,
Senator Harris, to explain the bill.

At 10:15 am Senator Luna assumed the chair.
At 10:20 am Senator Bivins resumed the chair.
Senator Bivins sent up Committee Amendment 1. Senator
Bivins pulled down Committee Amendment 1. Senator Bivins
moved that SB 312 be left pending; without objection, it
was so ordered.
The Chair laid out SB 537 and recognized the author,
Senator Ogden, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
Senator Sibley sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Ratliff moved that SB 537, as amended, be reported
back to the Senate with the recommendation that it do pass
and be printed. The motion carried with a vote of 11 ayes,
0 nays, 0 present not voting, and 0 absent.
The Chair recessed the committee at 11:25 am until 30
minutes after adjournment of the full Senate.
The committee reconvened at 1:47 pm.
The Chair laid out SB 471 and recognized the author,
Senator Luna, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
The Chair referred SB 471 to the Subcommittee on SB 471 for
further consideration. The Chair appointed Senator Luna as
Chair of the subcommittee and Senators Bivins and Ratliff
as members of the subcommittee.
The Chair laid out SB 69 and recognized the author, Senator
Haywood, to explain the bill. Senator Haywood sent up a
committee substitute; the Chair recognized Senator Haywood
to explain the difference between the committee substitute
and the bill as filed. Witnesses testifying and registering
on the bill are shown on the attached list. Senator Sibley
moved that SB 69 do not pass but that CSSB 69 be reported
back to the Senate with the recommendation that it do pass
and be printed. The motion carried with a vote of 10 ayes,
0 nays, 0 present not voting, and 1 absent. Senator
Haywood requested unanimous consent to certify the bill for
Local & Uncontested Calendar; without objection, it was so
ordered.
The Chair laid out SB 295 and recognized the author,
Senator Sibley, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached
list. Senator Sibley moved that SB 295 be left pending;
without objection, it was so ordered.
At 2:30 pm Senator West assumed the chair.
The Chair laid out SB 729 and recognized the author,
Senator Bivins, to explain the bill. Senator Bivins sent
up a committee substitute; the Chair recognized Senator
Bivins to explain the difference between the committee
substitute and the bill as filed. Witnesses testifying
and registering on the bill are shown on the attached list.
At 3:30 pm Senator Barrientos assumed the chair.
Senator Bivins moved that SB 729 do not pass but that CSSB
729 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 8 ayes, 0 nays, 0 present not
voting, and 3 absent.
At 3:50 pm Senator Bivins resumed the chair.
The Chair noted on record that written testimony was
received from Ann Faulkner.
There being no further business, at 3:55 pm Senator Bivins
moved that the Committee stand recessed subject to the call
of the Chair. Without objection, it was so ordered.
