         Pursuant to a notice posted in accordance with Senate Rule 
         11.11, a public hearing of the Senate Committee on Education 
         was held on Wednesday, February 12, 1997 in the Capitol 
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:35 am.  The 
         following business was transacted.  
         
         The Chair laid out SB 280 and recognized the author, Senator 
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a 
         committee substitute; the Chair recognized Senator Zaffirini 
         to explain the difference between the committee substitute and 
         the bill as filed.  Witnesses testifying and registering on 
         the bill are shown on the attached list.  Senator Zaffirini 
         moved that CSSB 280 be adopted by the committee.  There being 
         no objection, it was so moved. Senator Zaffirini moved that SB 
         280 do not pass but that CSSB 280 be reported back to the 
         Senate with the recommendation that it do pass and be printed.  
         The motion carried with a vote of 11 ayes, 0 nays, 0 present 
         not voting, and 0 absent.  
         
         At 9:45 am Senator Zaffirini assumed the chair.  
         
         The Chair laid out SB 150 and recognized the author, Senator 
         Bivins, to explain the bill.  Senator Bivins sent up a 
         committee substitute; the Chair recognized Senator Bivins to 
         explain the difference between the committee substitute and 
 
         





         the bill as filed.  Senator Bivins sent up Committee Amendment 
         1 and moved adoption; without objection, the amendment was 
         adopted.  Witnesses testifying and registering on the bill are 
         shown on the attached list.  Senator West sent up Committee 
         Amendment 2 and moved adoption.  Senator Bivins moved that SB 
         150 be left pending; without objection, it was so ordered. 
         There was no action taken on SB 296 by Sibley. 
         
         At 10:30 am Senator Bivins assumed the chair.  
         
         The Chair laid out SB 246 and recognized the author, Senator 
         Nelson, to explain the bill.  Senator Zaffirini sent up a 
         committee substitute; the Chair recognized Senator Nelson to 
         explain the difference between the committee substitute and 
         the bill as filed.  Witnesses testifying and registering on 
         the bill are shown on the attached list.  Senator Zaffirini 
         moved that SB 246 be left pending; without objection, it was 
         so ordered.
         
         The Chair laid out SB 247 and recognized the author, Senator 
         Nelson, to explain the bill.  Senator Zaffirini sent up a 
         committee substitute; the Chair recognized Senator Nelson to 
         explain the difference between the committee substitute and 
         the bill as filed.  Senator Ratliff sent up Committee 
         Amendment 1 and moved adoption; without objection, the 
         amendment was adopted.  Witnesses testifying and registering 
         on the bill are shown on the attached list.   Senator Bivins 
         moved that CSSB 247, as amended, be  adopted by the committee. 
         There being no objection, it was so moved. Senator Bivins 
         moved that SB 247 do not pass but that CSSB 247, as amended, 
         be reported back to the Senate with the recommendation that it 
         do pass and be printed, with the request of unanimous consent 
         to incorporate amendments into the committee substitute.    
         The motion carried with a vote of 10 ayes, 0 nays, 0 present 
         not voting, and 1 absent.  
         
         There being no further business, at 11:20 am Senator Bivins 
         moved that the Committee stand recessed subject to the call of 
         the Chair.  Without objection, it was so ordered.
