                          TELECOMMUNICATIONS UTILITIES

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Legislative Committee on  
         Municipal Franchise Agreements with Telecommunications  
         Utilities was held on Tuesday, September 30, 1997 in the  
         Capitol Extension, Room E1.028, at Austin, Texas.

         Representative Bill Carter, Co-Chair

         Senator Lucio, Co-Chair, called the meeting to order at 9:10  
         am.  There being a quorum present, the following business was  
         transacted.   
          
         The following members arrived after the roll was called:   
         none. 
          
         Representative Carter, Co-Chair, made opening remarks. 
          
         Senator Lucio, Co-Chair, welcomed the members. 
          
         Senator Lucio, Co-Chair, laid out the proposed rules.  Senator  
         Shapiro moved adoption of the committee rules.  The motion  
         carried with a vote of 6 ayes, 0 nays, 0 present not voting,  
         and 0 absent.   
          
         Senator Lucio and Representative Carter, Co-Chairmen, opened  
         the floor to invited testimony. 
         Pat Wood, III, representing The Public Utility Commission of  
         Texas, testified on the charge. 
         Jay Doegy, representing Texas Municipal League, testified on  
         the charge. 
         Charles Land, representing Texas Association of Long Distance  
         Telephone Companies, testified on the charge. 
         Henry G. Flores , representing Texas Telecommunications  
         Industry Coalition on Right of Way Issues, testified on the  
         charge. 
         A discussion followed the testimony of each witness. 
          
         Senator Lucio, announced that the Committee plans to meet on  
  
         November 20, 1997 in McAllen.  Other planned locations include  
         the Dallas area, Houston, San Antonio, El Paso and Lubbock. 
          
         There being no further business, at 11:20 am Representative  
         Hill moved that the Committee stand recessed subject to the  
         call of the Chair.  Without objection, it was so ordered.
