         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Friday, May 16, 1997  
         in the Capitol Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 8:00 am. The  
         following business was transacted.   
          
         Having stood at ease, the following members arrived after the  
         roll was called: Senators Galloway, Cain, Carona, Gallegos,  
         Jr., Madla, Moncrief, Ogden, Shapiro, and Whitmire  
          
         The Chair laid out HB 3587 and recognized the Senate sponsor,  
         Senator Haywood, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that HB 3587 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Galloway moved HB 3587 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Ogden moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar, without objection, it was  
  
         so ordered.   
          
         The Chair laid out HB 2850 and recognized the Senate sponsor,  
         Senator Galloway, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on

         The Chair moved that HB 2850 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Galloway moved HB 2850 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Galloway moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out HB 3540 and recognized the Senate sponsor,  
         Senator Galloway, to explain the bill.   
          
         Senator Galloway sent up a committee substitute; the Chair  
         recognized Senator Galloway to explain the difference between  
         the committee substitute and the bill as filed.

         The Chair moved that HB 3540 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Galloway moved adoption of the committee  
         substitute, without objection, it was so ordered. 
          
         Senator Galloway moved that HB 3540 do not pass but that CSHB  
         3540 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 11 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Galloway moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out HB 3594 and recognized the Senate sponsor,  
         Senator Lindsay, to explain the bill.

         the absence of the Senate sponsor, to explain the bill.

         quorum; without objection it was so ordered.  Upon arrival of

         senate with the recommendation that it do pass and be printed.

         in the absence of the Senate sponsor, to explain the bill.   
          
         The Chair moved that HB 3591 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Madla moved HB 3591 be reported back to the  
         senate with the recommendation that it do pass and be printed.

         At 8:30 am Senator Shapiro assumed the chair.   
          
         The Chair laid out HB 1891 and recognized Senator Lucio, Jr.,  
         in the absence of the Senate sponsor, to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.

         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Lindsay moved adoption of the committee

         Senator Lindsay moved that HB 1891 do not pass but that CSHB  
         1891 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 11 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Lindsay moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out HB 2345 and recognized Senator Lucio, Jr.,  
         in the absence of the Senate sponsor, to explain the bill.   
          
         The Chair moved that HB 2345 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Gallegos, Jr. moved HB 2345 be reported back  
         to the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 10 ayes, 1 nay, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out HB 2868 and recognized Senator Lucio, Jr.,  
         in the absence of the Senate sponsor, to explain the bill.   
          
         The Chair moved that HB 2868 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Whitmire moved HB 2868 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Whitmire moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At 8:40 am, the Committee stood at ease until 8:43 am. 
          
         At 8:43 am Senator Lucio, Jr. resumed the chair.   
          
         The Chair laid out HB 3583 and recognized Senator Lindsay, in  
         the absence of the Senate sponsor, to explain the bill.   
          
         The Chair moved that HB 3583 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Ogden moved HB 3583 be reported back to the  
         senate with the recommendation that it do pass and be printed.

         not voting, and 0 absent.   
          
         The Chair laid out HB 130 and recognized Senator Carona, in  
         the absence of the Senate sponsor, to explain the bill.   
          
         The Chair moved that HB 130 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Carona moved HB 130 be reported back to the  
         senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         At 9:00 am Senator Galloway moved that the Committee stand  
         recessed subject to the call of the Chair.  Without objection,  
         it was so ordered.   
          
         Chairman Lucio suspended all necessary rules to take up and  
         consider SB 1957 and HB 3603 upon adjournment of the Senate.   
         Without objection, it was so ordered. 
          
         The Committee reconvened at 1:00 pm, at Chairman Lucio's desk.  
          
         The Chair announced that SB 1957 was tagged.

         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         There being no further business, at 1:05 pm Senator Moncrief  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
