Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Thursday, May 1, 1997 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chair, Senator Cain, called the meeting to order at 9:15
am. There being a quorum present, the following business was
transacted.
The Chair laid out SB 989 and recognized the author, Senator
Nelson, to explain the bill. Senator Harris sent up a
committee substitute; the Chair recognized Senator Nelson to
explain the difference between the committee substitute and
the bill as filed. Witnesses testifying and registering on
the bill are shown on the attached list.
At 9:30 am Senator Shapleigh assumed the chair. Senator
Shapleigh moved that public testimony be closed and that SB
989 be left pending; without objection, it was so ordered.
The Chair laid out SB 1427 and recognized the author, Senator
Nelson, to explain the bill. Senator Lucio sent up a
committee substitute; the Chair recognized Senator Nelson to
explain the difference between the committee substitute and
the bill as filed. Witnesses testifying and registering on
the bill are shown on the attached list. Senator Shapleigh
moved that the public testimony be left open and the bill be
left pending until after adjournment of the Senate; without
objection, it was so ordered.
The Chair laid out SB 768 and recognized the author, Senator
Brown, to explain the bill. The Chair moved that SB 768 be
left pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Ellis moved SB 768
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 8
ayes, 0 nays, 0 present not voting, and 3 absent.
At 9:55 am, Senator Shapleigh moved that the Committee recess
until after adjournment of the Senate; without objection, it
was so ordered.
At 12:40 pm the Committee reconvened with Senator Sibley in
the Chair.
The Chair laid out SB 1940 and recognized the author, Senator
Carona, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that SB 1940 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Cain sent up a committee substitute; the Chair
recognized Senator Carona to explain the difference between
the committee substitute and the bill as filed. Senator Cain
moved adoption of the committee substitute, without objection,
it was so ordered. Senator Cain moved that SB 1940 do not
pass but that CSSB 1940 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
failed with a vote of 4 ayes, 3 nays, 0 present not voting,
and 4 absent.
At 1:00 pm Senator Cain assumed the Chair, laid out HB 1870
and recognized the Senate sponsor, Senator Sibley, to explain
the bill. Senator Cain sent up Committee Amendment 1.
Witnesses testifying and registering on the bill are shown on
the attached list. The Chair moved that HB 1870 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Sibley moved
adoption of Committee Amendment 1; without objection, it was
so ordered. Senator Sibley requested unanimous consent to
incorporate the amendment into a committee substitute; without
objection, it was so ordered. Senator Sibley then moved that
the new committee substitute be adopted; without objection, it
was so ordered. Senator Sibley moved that HB 1870 do not pass
but that CSHB 1870 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 3 absent.
Senator Sibley moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out HB 710, pending in Committee, and
recognized the Senate sponsor, Senator Sibley, to explain the
bill. Witnesses testifying and registering on the bill are
shown on the attached list. Senator Sibley sent up Committee
Amendment 1 but moved that the amendment be left pending.
Senator Sibley sent up Committee Amendment 2 and moved
adoption; without objection, the amendment was adopted.
Senator Sibley sent up Committee Amendment 3 and moved
adoption; without objection, the amendment was adopted.
Senator Sibley sent up Committee Amendment 5 and moved
adoption; without objection, the amendment was adopted.
Senator Sibley sent up Committee Amendment 6 and moved
adoption; without objection, the amendment was adopted.
Senator Sibley sent up Committee Amendment 7 and moved
adoption; without objection, the amendment was adopted.
Senator Sibley requested unanimous consent to incorporate the
amendments into a committee substitute; without objection, it
was so ordered. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Sibley moved that HB 710 do not pass but
that CSHB 710 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 3 absent.
At 1:30 Senator Sibley resumed the Chair, laid out SB 1446 and
recognized the author, Senator Harris, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The Chair moved that SB 1446 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Harris moved that
SB 1446 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 7 ayes, 1 nay, 0 present not voting, and 3 absent.
At 1:50 pm Senator Cain assumed the chair, laid out HB 1212,
pending in Committee, and recognized the Senate sponsor,
Senator Sibley, to explain the bill. Witnesses registering on
the bill are shown on the attached list. Senator Sibley sent
up Committee Amendment 1. Senator Shapleigh sent up Committee
Amendment 2. Senator Sibley sent up Committee Amendment 3.
The Chair moved that HB 1212 and amendments be left pending to
await a quorum; without objection it was so ordered. Upon
arrival of a quorum, Senator Sibley withdrew Committee
Amendment 1. Senator Shapleigh moved adoption of Committee
Amendment 2; without objection, the amendment was adopted.
Senator Sibley moved adoption of Committee Amendment 3;
without objection, the amendment was adopted. Senator Sibley
requested unanimous consent to incorporate the amendments into
a committee substitute; without objection, it was so ordered.

adopted; without objection, it was so ordered. Senator Sibley
moved that HB 1212 do not pass but that CSHB 1212 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 8 ayes, 0 nays,

At 2:00 pm Senator Sibley resumed the Chair, laid out SB 1142
and recognized the author, Senator Ellis, to explain the bill.
Senator Ellis sent up a committee substitute and explained the
difference between the committee substitute and the bill as
filed. Witnesses testifying and registering on the bill are
shown on the attached list. The Chair moved that SB 1142 be
left pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Ellis moved SB
1142 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 7 ayes, 1 nay, 0 present not voting, and 3 absent.
The Chair moved that SB 1427, by Senator Nelson, which was
laid out earlier in the hearing be left pending; without
objection, it was so ordered.
The Chair laid out HB 39, pending in Committee. Senator Sibley
advised that Committee Amendments 1 and 2, adopted at an
earlier hearing, had been incorporated into a committee
substitute. Senator Sibley moved reconsideration of the
incorporation of amendments 1 and 2; without objection, it was
so ordered. Senator Sibley sent up Committee Amendment 3 and
moved adoption; without objection, the amendment was adopted.
Senator Sibley requested unanimous consent to incorporate the
amendments into a committee substitute; without objection, it
was so ordered. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Shapleigh moved that HB 39 do not pass but
that CSHB 39 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 3 absent.
Senator Ellis moved that the bill be recommended for placement

recognized Senator Haywood, in the absence of the author, to

Senator Sibley moved that SB 1798 be left pending; without
objection, it was so ordered.
The Chair laid out SB 1037 and recognized the author, Senator
Ellis, to explain the bill. Senator Ellis sent up Committee
Amendment 1 and moved adoption; without objection, the
amendment was adopted. Witnesses testifying and registering

so ordered.

There being no further business, at 5:00 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
