                    SENATE COMMITTEE ON ECONOMIC DEVELOPMENT

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Economic  
         Development was held on Thursday, April 24, 1997 in Lt.  
         Governor's Committee Room, at Austin, Texas.

         The Chair called the meeting to order at 9:05 am.  There being  
         a quorum present, the following business was transacted.   
          
         At 9:10 am Senator Cain assumed the chair, laid out HB 3 and  
         recognized the Senate sponsor, Senator Sibley, to explain the  
         bill.   
          
         At 9:55 am the Chair advised that consideration of HB 3 would  
         be suspended until after adjournment of the Senate and that  
         testimony would continue at that time.  The Chair moved that  
         the Committee recess until after adjournment of the Senate;  
         without objection, it was so ordered. 
          
         At 3:30 pm the Committee reconvened, with Senator Patterson in  
         the Chair.  Consideration of HB 3 resumed and testimony  
         continued.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The Chair moved that HB 3 be  
         left pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Sibley sent up  
         Committee Amendment 1 and moved adoption; without objection,  
         it was so ordered.  Senator Sibley sent up Committee Amendment  
         2 and moved adoption; without objection, it was so ordered.   
         Senator Sibley requested unanimous consent to incorporate the  
  
         amendments into a committee substitute; without objection, it  
         was so ordered.  Senator Sibley then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Sibley moved that HB 3 do not pass but that  
         CSHB 3 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 8 ayes, 2 nays, 0 present not voting, and 1 absent.   
          
         At 3:55 pm Senator Sibley resumed the chair.   
          
         The Chair laid out HB 565 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 565 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Ellis moved HB 565 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 2 absent.   
          
         Senator Ellis moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair laid out HB 567 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  The resource witness is  
         shown on the attached list.  The Chair moved that HB 567 be  
         left pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Ellis moved HB 567  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 9  
         ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         Senator Ellis moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair laid out HB 922 and recognized the Senate sponsor,  
         Senator Duncan, to explain the bill.  The witness testifying  
         in support of the bill is shown on the attached list.  The  
         Chair moved that HB 922 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Duncan moved HB 922 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 2 absent.   
         Senator Duncan moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out SB 599 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Shapiro sent up a  
         committee substitute and explained the difference between the  
         committee substitute and the bill as filed.  Witnesses  
  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Sibley moved that SB 599 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1197 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley moved that SB 1197 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1076 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley moved that SB 1076 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1479 and recognized Senator Shapiro, in  
         the absence of the author, Senator Bivins, to explain the  
         bill.  Carol Taylor, representing Texas Trial Lawyers  
         Association, registered in opposition to the bill but did not  
         testify.  Senator Sibley moved that SB 1479 be left pending;  
         without objection, it was so ordered. 
          
         The Chair laid out HB 39, pending in Committee, and recognized  
         Senator Shapleigh, in the absence of the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Senator Shapiro sent  
         up Committee Amendment 1.  Senator Harris sent up Committee  
         Amendment 2.  Following explanation of the amendments, Senator  
         Sibley moved that HB 39 and the amendments be left pending;  
         without objection, it was so ordered. 
          
         At 5:30 pm Senator Shapleigh assumed the chair.   
          
         The Chair laid out HB 1975 and recognized the Senate sponsor,  
         Senator Sibley, to explain the bill.  Senator Sibley sent up a  
         committee substitute and explained the difference between the  
         committee substitute and the bill as filed.  Witnesses  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 1975 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Sibley moved adoption of the committee  
         substitute, without objection, it was so ordered.  Senator  
         Sibley moved that HB 1975 do not pass but that CSHB 1975 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 8  
         ayes, 1 nay, 0 present not voting, and 2 absent.   
          
         The Chair laid out HB 710 and recognized the Senate sponsor,  
         Senator Sibley, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley sent up Committee Amendment 1,  Committee  
         Amendment 2 and Committee Amendment 3. Senator Shapiro sent up  
         Committee Amendment 4.  Senator Sibley moved that HB 710 be  
         left pending; without objection, it was so ordered. 
          
         The Chair laid out HB 1212 and recognized the Senate sponsor,  
         Senator Sibley, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley moved that HB 1212 be left pending; without  
         objection, it was so ordered. 
          
         At 6:10 pm Senator Sibley resumed the chair.  The Chair moved  
         that SB 1155, pending in Committee, be left pending; without  
         objection, it was so ordered. 
          
         There being no further business, at 6:25 pm Senator Sibley  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
