         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Economic  
         Development was held on Tuesday, April 8, 1997 in the Lt.  
         Governor's Committee Room, at Austin, Texas.

         The Chair called the meeting to order at 9:10 am.  There being  
         a quorum present, the following business was transacted.   
          
         At 9:10 am Senator Cain assumed the chair, laid out SB 738 and  
         recognized the author, Senator Carona, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Cain moved that SB 738 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 739 and recognized the author, Senator  
         Carona, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Lucio sent up a committee substitute; the Chair  
         recognized Senator Carona to explain the difference between  
         the committee substitute and the bill as filed.  Senator Lucio  
         then  adoption of the committee substitute; without objection,  
         it was so ordered.  The Chair moved that CSSB 739 be left  
         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Lucio moved that  
         SB 739 do not pass but that CSSB 739 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
  
         not voting, and 0 absent.  Senator Lucio moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1913 and recognized Senator Madla, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Sibley sent up a committee substitute;  
         the Chair recognized Senator Madla to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Sibley moved adoption of the committee substitute;  
         without objection, it was so ordered.  The Chair moved that  
         CSSB 1913 be left pending to await a quorum; without objection  
         it was so ordered.  Upon arrival of a quorum, Senator Sibley  
         moved SB 1913 do not pass but that CSSB 1913 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   Senator Lucio moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar, without objection, it was so ordered.   
          
         The Chair laid out SB 1447 and recognized Senator Madla, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Harris sent up a committee substitute;  
         the Chair recognized Senator Madla to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Harris moved adoption of the committee substitute;  
         without objection, it was so ordered.  The Chair moved that  
         CSSB 1447 be left pending to await a quorum; without objection  
         it was so ordered.  Upon arrival of a quorum, Senator Cain  
         moved SB 1447 do not pass but that CSSB 1447 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out SB 682 and recognized the author, Senator  
         Armbrister, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Lucio sent up a proposed committee substitute; the  
         Chair recognized Senator Armbrister to explain the difference  
         between the proposed committee substitute and the bill as  
         filed.  Senator Lucio sent up Committee Amendment 1 and  moved  
         adoption; without objection, the amendment was adopted.   
         Senator Lucio requested unanimous consent to incorporate the  
         amendment into a new committee substitute; without objection,  
         it was so ordered. Senator Lucio then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered. The Chair moved that SB 682 be left pending to await  
         a quorum; without objection it was so ordered.  Upon arrival  
         of a quorum, Senator Lucio moved that SB 682 do not pass but  
         that CSSB 682 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent. 
  
         The Chair laid out SB 265 and recognized Senator Harris, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Harris sent up a proposed committee  
         substitute; the Chair recognized Senator Harris to explain the  
         difference between the proposed committee substitute and the  
         bill as filed.  Senator Harris sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator Harris requested unanimous consent to  
         incorporate the amendment into  a new committee substitute;  
         without objection, it was so ordered.  Senator Harris then  
         moved that the new committee substitute be adopted; without  
         objection, it was so ordered. The Chair moved that SB 265 be  
         left pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Harris moved that  
         SB 265 do not pass but that CSSB 265 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 11 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         The Chair laid out SB 555 and recognized the author, Senator  
         Sibley, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  
         Senator Sibley sent up Committee Amendment 2 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Sibley sent up Committee Amendment 3 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Sibley sent up Committee Amendment 4 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Sibley moved that SB 555 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 976, which was pending, and recognized  
         the author, Senator Madla, to explain the bill.  Senator Madla  
         sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted. Senator Madla requested  
         unanimous consent to incorporate the amendment into a new  
         committee substitute; without objection, it was so ordered.   
         Senator Madla then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Madla  
         moved that SB 976 do not pass but that CSSB 976 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 11 ayes, 0  
         nays, 0 present not voting, and 0 absent.   
          
         The Chair laid out SB 865, which was pending, and recognized  
         the author, Senator Patterson, to explain the bill.  Senator  
         Patterson withdrew a committee substitute which he laid out at  
         a previous meeting, held by the Economic Development  
         Committee, on April 1, 1997.  Senator Patterson sent up a new  
         committee substitute and explained the difference between the  
         new committee substitute and the previous committee  
  
         substitute.  Senator Patterson moved adoption of the new  
         committee substitute; without objection, it was so ordered.   
         Senator Patterson moved that SB 865 do not pass but that CSSB  
         865 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 10 ayes, 0 nays, 0 present not voting, and 1 absent.   
         Senator Patterson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out SB 1837 and recognized Senator Sibley, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Sibley moved that SB 1837 be reported  
         favorably to the full Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 10  
         ayes, 0 nays, 0 present not voting, and 1 absent. Senator  
         Sibley moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         At 10:25 am Senator Patterson assumed the chair and laid out  
         SB 932 and SB 1265 and recognized Senator Sibley to explain  
         the bills.  Senator Sibley sent up a committee substitute to  
         SB 932 and explained the difference between the committee  
         substitute and the bill as filed.  Senator Sibley moved  
         adoption of the committee substitute; without objection, it  
         was so ordered.  The Chair moved that SB 932 be left pending  
         while Senate is in session; without objection it was so  
         ordered.  Upon adjournment of the session, Senator Sibley  
         moved SB 932 do not pass but that CSSB 932 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 9 ayes, 1 nay, 0  
         present not voting, and 1 absent.   
          
         Senator Sibley moved that SB 1265 be left pending; without  
         objection, it was so ordered. 
          
         There being no further business, at  2:15 pm Senator Sibley  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
