Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Thursday, April 3, 1997 in the Senate
Chamber at Austin, Texas.

The Chair called the meeting to order at 9:15 am. There being
a quorum present, the following business was transacted.
At 9:18 am Senator Madla assumed the chair.
The Chair laid out SB 746, SB 747, SB 1409, SB 1557 and
recognized the author, Senator Sibley, to explain the first
bill SB1409. Witnesses testifying and registering on the bill
are shown on the attached list. Senator Sibley moved that SB
1409 be left pending; without objection, it was so ordered.
The Chair then recognized the author, Senator Sibley, to
explain SB 746. Senator Sibley sent up a committee substitute;
the Chair recognized Senator Sibley to explain the difference
between the committee substitute and the bill as filed.
Witnesses testifying and registering on the bill are shown on
the attached list. Senator Sibley moved adoption of the
committee substitute, without objection, it was so ordered.
Senator Sibley moved that SB 746 do not pass but that CSSB 746
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 9
ayes, 0 nays, 0 present not voting, and 2 absent.
The Chair then recognized the author, Senator Sibley, to
explain SB 747. Senator Sibley sent up and explained a
proposed committee substitute for SB 747. Witnesses testifying
and registering on the bill are shown on the attached list.
Senator Sibley sent up Committee Amendment 1 to the proposed
committee substitute and moved adoption; without objection,
the amendment was adopted. Senator Sibley sent up Committee
Amendment 2 to the proposed committee substitute and moved
adoption; without objection, the amendment was adopted.
Senator Sibley sent up Committee Amendment 3 to the proposed
committee substitute and moved adoption; without objection,
the amendment was adopted. Senator Shapiro sent up Committee
Amendment 4 to the proposed committee substitute and moved
adoption. The motion failed by a vote of 3 ayes, 7 nays, 0
present not voting, and 1 absent. Senator Sibley requested
unanimous consent to incorporate amendments into the proposed
committee substitute. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Sibley moved that SB 747 do not pass but
that CSSB 747 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 10 ayes, 0 nays, 0 present not voting,
and 1 absent.
The Chair then recognized the author, Senator Sibley, to
explain SB 1557. Witnesses testifying and registering on the
bill are shown on the attached list. Senator Sibley sent up
Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Sibley requested unanimous
consent to incorporate the amendment into a committee
substitute. Senator Sibley then moved that the new committee
substitute be adopted; without objection, it was so ordered.
Senator Sibley moved that SB 1557 do not pass but that CSSB
1557 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 9 ayes, 0 nays, 0 present not voting, and 2 absent.
The Chair laid out SB 1450 and recognized the author, Senator
Nelson, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that SB 1450 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Lucio moved SB 1450 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 9 ayes, 0 nays, 0 present
not voting, and 2 absent. Senator Shapiro moved that the bill
be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.
The Chair laid out SB 976 and recognized the author, Senator
Madla, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Madla moved that SB 976 be left pending; without
objection, it was so ordered.
There being no further business, at 6:25 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
