         Pursuant to a suspension of the 5-day posting rule on February 
         5, 1997, the House Committee on Higher Education met jointly 
         with the Appropriations Subcommittee on Education and the 
         Appropriations Subcommittee on Public Safety, Criminal Justice 
         and Judiciary in a public hearing and was called to order by the 
         Chair, Representative Irma Rangel at 8:09 am.
         
         The roll was answered as follows:  
         
         Present:  Representatives Rangel; Solis; Cuellar; Dunnam; Kamel; 
                   Rabuck (6).
         
         Absent:   Representatives Bailey; Reyna, Elvira; Rodriguez (3).
         
         A quorum was present.

         Testimony was taken.  (See attached witness list.)
         
         Attorney General, Dan Morales and members of his office 
         testified regarding a recently issued legal opinion.
         
         Testimony was also given by Commissioner Kenneth Ashworth, Texas 
         Higher Education Coordinating Board on the same subject matter.
         
         At 9:55 am, on the motion of the chair and without objection, 
         the meeting was adjourned subject to the call of the chair.
