No. 1242 74R14228 DRH-D R E S O L U T I O N 1-1 WHEREAS, Barbara Thomas, Edward Blum, Pauline Orcutt, Kenneth 1-2 Powers, Edward Chen, Al Vera, Matt Jansha, Shirley Thompson, and 1-3 John Bueckner, registered voters of this state, have instituted 1-4 legal proceedings challenging the validity of certain state 1-5 representative districts of the State of Texas; and 1-6 WHEREAS, An agreement has been reached that addresses 1-7 concerns of these citizens without adversely affecting the voting 1-8 rights of any other group of citizens of this state; and 1-9 WHEREAS, It is the desire of the House of Representatives to 1-10 provide for timely elections and to avoid unnecessary legal 1-11 expenses and further uncertainty in the configuration of state 1-12 representative districts; now, therefore, be it 1-13 RESOLVED, That the House of Representatives of the 74th Texas 1-14 Legislature hereby directs the attorneys representing the state in 1-15 the case of Thomas et al. v. Bush et al., Civil Action No. 1-16 A-95-CV-186-SS in the United States District Court for the Western 1-17 District of Texas, Austin Division, to seek a judgment from the 1-18 court that resolves that litigation as it relates to state 1-19 representative districts by allowing for the use of the state 1-20 representative districts described in PLANH738, the current 1-21 redistricting plan for the House of Representatives, with the 1-22 modifications provided by PLANH846, as contained in the 1-23 Redistricting Application Computer operated by the Texas 1-24 Legislative Council, in the general election to be held in November 2-1 1996; and, be it further 2-2 RESOLVED, That the House of Representatives of the 74th Texas 2-3 Legislature hereby authorizes the staff of the Texas Legislative 2-4 Council, at the direction of the speaker of the house and with the 2-5 approval of each member of the House of Representatives 2-6 representing the affected districts, to make technical changes to 2-7 the plan referred to above to eliminate voting precincts containing 2-8 no population or very little population.
