BILL ANALYSIS S.B. 958 By: Harris Administration 03-23-95 Committee Report (Unamended) BACKGROUND The State of Texas is in the process of making nonsubstantive revisions to and recodifying its statutes. PURPOSE As proposed, S.B. 958 recodifies and makes nonsubstantive revisions to Acts relating to state purchasing and general services, including conforming amendments, repealers, and penalties. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Recodifies and makes nonsubstantive changes to the Government Code, including conforming amendments, repealers, and penalties. SECTION 2. Makes conforming amendments to Section 5.19, Article 601b, V.T.C.S., and transfers and redesignates that section to Section 444.029, Government Code. SECTION 3. Makes conforming amendments to Section 3.051, Article 601b, V.T.C.S., and transfers and redesignates that section to Section 465.018, Government Code. SECTION 4. Repealer: Chapter 2202, Government Code (Texas Surplus Property Agency). SECTION 5. Repealer: Article 601b, V.T.C.S. (State Purchasing and General Services Act). SECTION 6. Provides that this Act is intended as recodification only and is not intended to substantively change the law. SECTION 7. SAVINGS PROVISION. (a) Provides that the revision and codification by this Act of a statute relating to a fund in existence on or before August 31, 1993, does not re-create the fund and does not constitute the reenactment of a dedication of revenue. (b) Provides that a fund or account, the existence of which is derived from a statute revised by this Act and which is abolished under Section 403.094, Government Code, before the effective date of this Act is not revived or re-created by this Act. (c) Provides that the application of Sections 403.094 and 403.095, Government Code, to a fund or to the permissible uses of revenue or fund balances is not affected by this Act. SECTION 8. Effective date: September 1, 1995. SECTION 9. Emergency clause.
