BILL ANALYSIS H.B. 1625 By: Madden March 30, 1995 Committee Report (Unamended) BACKGROUND Two precincts (94 and 95) are uninhabited in Collin County and the two state representative districts that are affected (Districts 66 and 67, respectively) can each be slightly redistricted to more appropriately accommodate these erroneous designations without any significant adjustments other than mapping alterations. PURPOSE H.B.1625 would enable the Commissioners Court of Collin County to effectively eliminate two uninhabited precincts (94 and 95) that comprise road right-of-way in State Representative Districts 66 and 67 respectively. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Revises Sections 66 and 67, Article II, Chapter 2, Acts of the 72nd Legislature, 3rd Called Session, 1992 by correctly identifying the constituent elements that delineate House Districts 66 and 67 despite the erroneous designations of Precincts 94 and 95 in Collin County. SECTION 2: Amends Section 1, Article III, Chapter 2, Acts of the 72nd Legislature, 3rd Called Session, 1992 by adding subsection (d) to make clear how to interpret the data contained in the Redistricting Map Data Base for the State of Texas described by subsection (a) of this section. SECTION 3: Subsection (a) indicates that in the 1996 election for members of the 75th Legislature, the new configurations of House Districts 66 and 67 come into play. Subsection (b) says if a vacancy were to occur during the 74th Legislature, the current 66 and 67 district lines would be applicable for that election. SECTION 4: Emergency and effective date clause. SUMMARY OF COMMITTEE ACTION Pursuant to public notice posted March 23, 1995, the House Committee on Redistricting met in a public hearin on March 28, 1995. Representative Madden explained the bill. The bill was reported favorably without amendment, with the recommendation that it do pass and be printed, by a record vote of 7 ayes, 0 nays, 0 present not voting, and 4 absent.
