   1-19                         A BILL TO BE ENTITLED
   1-20                                AN ACT
   1-21  relating to the rulemaking authority of the Texas Water Commission
   1-22  regarding underground water.
   1-23        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-24        SECTION 1.  Section 28.011, Water Code, is amended to read as
   1-25  follows:
   1-26        Sec. 28.011.  UNDERGROUND WATER:  REGULATIONS.  The
   1-27  commission may <shall> make and enforce rules and regulations for
   1-28  <conserving,> protecting and<,> preserving the quality of<, and
   1-29  distributing> underground<, subterranean, and percolating> water
   1-30  <located in this state and shall do all other things necessary for
   1-31  these purposes>.
   1-32        SECTION 2.  The importance of this legislation and the
   1-33  crowded condition of the calendars in both houses create an
   1-34  emergency and an imperative public necessity that the
   1-35  constitutional rule requiring bills to be read on three several
   1-36  days in each house be suspended, and this rule is hereby suspended,
   1-37  and that this Act take effect and be in force from and after its
   1-38  passage, and it is so enacted.
